OBSERVATION:Annual monitoring system certification, leak detector testing, and spill container testing was performed on 4/8/2021 and a test report was submitted on 5/11/2021, 3 days late. REGULATION GUIDANCE:A copy of the test report must be submitted within 30 days of the tests. CORRECTIVE ACTION: Take all necessary precautions to ensure testing and submittal of test reports are performed in a timely manner. This is a Class II violation. 208 CCR 2716(a-e) Failure to comply with the designated operator inspection requirements. OBSERVATION: The designated operator failed to check and note the correct test dates for the overfill prevention on the designated operator inspection reports dated 6/1/2021 to 10/19/2021. The correct date for overfill prevention is 5/24/2021. REGULATION GUIDANCE: During the inspection, the designated operator shall check that all required testing and maintenance for the UST system have been completed and document the dates they were done. CORRECTIVE ACTION: Ensure that designated operators performing inspections at this facility are including all of the required information on the reports. This is a repeat violation, Class Il. 308 CCR 2632(c), 2634(d), 2636(f) Failure of the leak detection equipment to have an audible and visual alarm. OBSERVATION: The 87 fill sump sensor(tank 1)failed to activate an audible and visual alarm when tested to ensure continuous monitoring of the tank system. REGULATION GUIDANCE:All monitoring equipment shall be maintained to activate an audible and visual alarm or stop the flow of product at the dispenser when it detects a leak. CORRECTIVE ACTION: The sensor was replaced and retested during the inspection. This is a repeat violation, Class II. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by May 7, 2022.
