OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually by the due date, January 15. The hazardous materials inventory was last submitted on 1/17/2017 and has not been submitted for 2018, 2019, 2020, 2021, and 2022. The facility information and emergency response and training plans were last submitted on 12/4/2017 and have not been submitted for 2019, 2020, 2021, and 2022. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a Class II violation. 10 HSC 25508.1(a)-(f) Failed to electronically update the HMBP within 30 days of substantial change in operations. OBSERVATION: During the inspection it was found the Primary and Secondary Emergency Contacts have not been affiliated with this facility in over a year and at least 192 gallons of flammable hand sanitizer was found inside the maintenance room at the northwest area of the facility. The material has been at the location longer than a year. The business has not updated and submitted the information within 30 days. REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the information submitted to the California Environmental Reporting System (CERS): a) A 100 percent or more increase in the quantity of a previously disclosed material. b) Any handling of a previously undisclosed hazardous materials c) A change of business or facility address d)Change business ownership e)Change of business name f)(1)A substantial change in the handler's operations occurs that requires modification to any portion of the business plan. (2) For the purpose of this subdivision, "substantial change" means any change in a facility that would inhibit immediate response during an emergency by either site personnel or emergency response personnel, or that could inhibit the handler's ability to comply with Section 25507, change the operational knowledge of the facility, or impede implementation of the business plan.
