`.ITY OF TRAC ie"
Dr. Jack Williams, M.D.
District Health Officer
1601 E. Hazelton Avenue
Stockton, California
Re: Howard Black Subdivision
Map # S-80-7
Dear Dr. Williams:
October 9, 1980
JJ
IIrr I _
'-
OCT 14 1980 lig
SRN .iG-`i N i 4L
HEALTH- DISTR;CT
I am writing this letter to confirm our understanding
reached in our telephone conversation this morning regarding
the above -referenced subdivision.
As I indicated over the phone, the city is very much
concerned about the possible degradation of ground water supplies
and nuisance created by a package treatment plant proposal for
the above -referenced 42 -unit subdivision.
The city had filed a lawsuit against the County of San
Joaquin regarding this particular subdivision. That decision was
contrary to the city. However, we believe our chances of a
successful appeal are very good. Rather than burden the courts
and all parties concerned, however, we would be willing to forego
such an appeal if the city were allowed to comment upon the
proposed package plant prior to the health district's determin-
ation to approve or disapprove it.
You graciously consented to the city's obtaining copies
of what the developer proposes to construct, and allowing the
city to comment upon such proposal prior to making a decision
thereon.
I understand that the person who should be contacted
by city staff is Mr. Lee Hall.
regard.
RM:br
Thank -you for your courtesy and cooperation in this
Ver truly yours,
1LI ZIl
ROBERT MEHLHAFF
Assistant City Attorney
Telephone 209/835-2211 P.O.
