Evans, aka Mick Evans <br /> In care of Helen McAnally LF Trust <br /> 22865 South Henry Road <br /> Escalon, CA 95320 <br /> RE: NOTICE OF PENALTY ASSESSMENT, NOVEMBER 10, 2008 NOTICE AND ORDER <br /> SNYDER DUMP, 22865 SOUTH HENRY ROAD, ESCALON, CA 95320 <br /> OWNER APN 249-060-10 <br /> Regulatory San Joaquin County Environmental Health Department (EHD), as the Local <br /> Authority Enforcement Agency (LEA), is authorized by Division 30 of the Public Resources <br /> Code (PRC), Section 43209 and 45000 and Title 14 of the California Code of <br /> Regulations (CCR), to enforce applicable solid waste regulations within the County of <br /> San Joaquin. <br /> Division 30, Part 5 of the PRC and Sections 18304 and 18304.1 14CCR authorizes <br /> the LEA to issue enforcement orders for violations of the PRC and regulations <br /> adopted pursuant to Division 30. The PRC, sections 45011 and 45023 also authorize <br /> the LEA to assess penalties for failure to comply with the enforcement order. <br /> Background This disposal site poses a threat to human health, safety and the environment from <br /> chemical and physical hazards, from exposed solid and hazardous wastes. Violations <br /> were initially identified on November 20, 2003 and the property owner was notified. <br /> The same violations were again identified and documented at this site on May 18, <br /> 2004, September 28, 2005, October 31, 2006, December 6, 2007, December 12, <br /> 2008, December 9, 2009, December 30, 2010, September 15, 2011, and December 8, <br /> 2011 which are: <br /> 1. Title 27 CCR Section 20650 Grading of Fill Surfaces. Improper grading of fill <br /> surfaces, <br /> 2. Title 27 CCR Section 20820 Drainage/Erosion Control. Improper <br /> drainage/erosion control. <br /> 3. Title 27 CCR Section 20750 Site Maintenance. Abandoned autos and other <br /> solid waste on the property. <br /> A Notice and Order (Order) was issued to the owner/operator of the site on November <br />
