with the terms of this order, the owner and operator may be required to take further actions as necessary to
protect public health, safety or the environment.
The LEA shall not be liable for injuries or damages to persons or property resulting from acts or
omissions by the owner or operator or related parties in carrying out activities pursuant to this order, nor
shall the LEA be held as a party to any contract entered into by the owner or operator or their agent(s) in
carrying out activities pursuant to this order.
This order is supported by the accompanying declaration of Natalia Subbotnikova, Senior REHS.
This Notice and Order does not relieve the operator or property owner from complying with all other
local, state, and federal requirements. If such measures are required and if fulfillment of such requirements impacts your
ability to comply with the compliance schedule in this Order, you may submit a written request to the
LEA on or before December 14, 2008 for an extension of time with respect to the deadlines in the
compliance schedule. Any such request must set forth the identity of the agency or agencies involved the
measure they require to be taken and justification for why fulfillment of such requirements impacts your
ability to comply with the compliance schedule in this Order.
This order is issued as of the date set forth below.
Dated:
Robert McClellon,Program Coordinator, REHS
Environmental Health Department
San Joaquin County
Cc: John Macanas, Integrated Waste Management Board
David Irey, San Joaquin County District Attorney Office
