San Joaquin Valley <br /> Unified Air Pollution Control District <br /> June 18, 1998 <br /> Compliance Department <br /> San Joaquin Valley Unified Air Pollution Control District <br /> 4230 Kiernan Ave. <br /> Modesto, CA 95356 <br /> Subject: Illegal Bum at Santa Fe and Henry, San Joaquin County <br /> On June 9, 1998 at 8:00am, Reporting Inspector Rod Swartzendruber arrived at <br /> an open field east of the T-intersection formed by Santa Fe and Henry Roads. <br /> R/I observed several piles of tree limbs, tree stumps, metal and plastic trash. <br /> The materials appeared to be purposefully gathered into the piles as they were <br /> located next to a dirt road and tire tracks could be observed leading directly to <br /> where the piles were formed. Several of the piles appeared to have been <br /> burning for a long time and pictures were taken at the scene. <br /> On June 9, 1998 at 4:57pm, R/I arrived at 23125 Henry Road and contacted Mr. <br /> Bill Lane, owner of the residence. Mr. Lane stated that he owns the property <br /> where the burn occurred. He further stated that on Saturday, June 6, 1998 at <br /> about 7:00am, two young men in a pickup truck came onto the property and <br /> ignited the piles of debris in the field. Mr. Lane stated that he was sleeping at the <br /> time and a young man driving by his residence (who he did not know) told him <br /> about the two men in the pickup truck. <br /> Mr. Lane stated that he intends to sell the property where the bum occurred and <br /> has been trying to clean it up. He stated that he hoped to sell the property before <br /> it went into foreclosure. Mr. Lane further informed R/I that grass growing to the <br /> south of his property was a safety hazard and he could not understand why the <br /> District prohibits the burning of the grass in order to eliminate the hazard. <br /> When informed that, as the owner of the property where the burn occurred, he <br /> was subject to violation of District Rule 4301, Open Burning, Mr. Lane became <br /> upset. He stated that he had "killed a guy" 13 years ago and was currently on <br /> probation. He further stated that anything the District could do to him was <br /> nothing compared to what he had gone through in the past.
