1) Ashpalt road paving equipment painted green in the northeast end of the property with signs identifying it as the property of Cornish Construction, 537-7459, Lic# 270025. m) A fifteen square foot area of soil stained with thick black liquid next to the asphalt equipment. n) An approximately thirty foot long by two feet wide area of dark black sand spread on top of the earth which appeared to be sandblast waste. o) A Caterpillar tractor with rippers and bulldozer blade on the south end of the property. p) A Caterpillar tractor loaded on a trailer on the northeast end of the property. q) One 12 volt equipment battery laying on its side, located on the east side of the property near the entry gate on Santa Fe Road. After determining that hazardous materials and waste were also present on the east and northeast sections of the property, Jim Czarnecki and I drove to the Escalon Fire Department as planned. Jim Czarnecki and I arrived at the Escalon Fire Department at approximately 1025. Fire Chief Jim Rosenberg explained that he had received two complaints that day about the smoke and fire on "Wild Bill's" property. According to Chief Rosenberg, a fire from the railroad siding spread onto Mr. Lane's property on July 16, 1990 and has continued to burn or smolder since that date. On July 16, 1990, Riverbank Fire Department was dispatched by Stanislaus County to the fire along the railroad tracks. Riverbank Fire Department extinguished the fire along the _ railroad tracks, however the fire on Mr. Lane's property was not within the jurisdiction of l Riverbank Fire Department and was left to burn itself out. The fire did not burn itself out, and Escalon Fire Department was reluctant to enter Mr. Lane's property to extinguish the fire. Chief Rosenberg stated that the Fire Department would probably not be able to recover costs from Mr. Lane for putting out the fire on his property. Mr. Lane was described as being foul- mouthed, difficult to deal with, a both unpleasant and excentric character, and an ex-rodeo clown who occaisionally rides a buffalo through town. Chief Rosenberg also stated that he would not enter Mr. Lane's property unless a Sheriff was present. I got the impression that the Escalon Fire Department would prefer to not confront or deal with Mr. Lane. Fire Chief, Jim Rosenberg received a phone complaint from Mr. Jim Cocco (29901 E. Hall Road, 838-6839) which was referred to myself at 1100. Mr. Cocco stated that he saw Bill Lane bury batteries, tires and oil on the property repeatedly over the past four years. Mr. Cocco complained that Mr. Bill Lane starts fires on the property to burn waste and garbage, and that Mr. Lane had reignited the fire on the property earlier that week when it looked as though it would burn out. Mr. Cocco is willing to testify as a witness, and stated that he has already filed a complaint against Mr. Lane for an alleged assault and discharge of a fire arm (pistol) on a previous date.
