Mr. Cocco stated that he had taken pictures of the fire and Bill Lane that <br /> afternoon: I warned him to be discreet and to contact me if the fire was not extinguished that day <br /> or if it started again over the weekend. <br /> At approximately 3:50, 1 received a phone call from Mr. Lane. He complained that he saw "that <br /> asshole, Jim Cocco" taking pictures of him, and asked if Jim Cocco had made the complaint. I <br /> replied that more than one person had made complaints and that I would not reveal their names. <br /> asked if the fire was out, but did not receive a reply from Mr. Lane. Before Mr. Lane hung up <br /> the phone, I again warned that the fire must be extinguished "today". <br /> At 8:00 a.m. August 14, 1990, Art Bentley, San Joaquin County OES Hazardous Materials <br /> Specialist, said that he saw the fire on Mr. Lane's property continuing to burn over the weekend <br /> and was burning the evening of August 13. <br /> At 9:26 a.m. August 14, 1990, Terry from the Escalon Fire Department (838-7500) phoned <br /> and said that the fire on Mr. Lane's property was burning the evening of August 13, and that <br /> neighbors had complained about the smoke. <br /> At 9:54 a.m. August 14, 1990, Melissa Aronson (838-1869) phoned and said that she is a <br /> neighbor of Mr. Lane's and complained that the fire on Mr. Lane's property was still burning <br /> and generating an irritating smoke. Melissa Aronson also claimed that Mr. Lane burns garbage <br /> on his property on a regular basis and offered to testify as a witness if needed. <br /> On August 14, 1990, 1 prepared a declaration in support of a preliminary injunction and <br /> submitted it to the San Joaquin District Attorney's Office. <br />
