CONDITIONS OF APPROVAL <br /> MS-93-76 <br /> Andy Leonardini, Sr. <br /> Unless otherwise specified, all Conditions of Approval shall be complied with prior to the approval <br /> of the Parcel Map. <br /> This approval will expire three years from the date of approval unless (1) all Conditions of Approval <br /> have been complied with and (2) a Parcel Map has been filed with and accepted by the Surveyor's <br /> Office. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance requirements. Ordinance requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. Parcel 1 shall have a minimum width of 330 feet, and parcel 2 shall have a minimum width <br /> of 150 feet. (Development Title Section 9-610.2) <br /> b. Parcel 2 shall be between 2 net acres and 5 gross acres in size. (Development Title <br /> Section 9-610.3[a]) <br /> C. The following note shall be placed on the Parcel Map and also recorded as a separate <br /> instrument: <br /> In accordance with Section 9-610.3 of the San Joaquin County Development Title for the <br /> creation of homesite parcels, these parcels cannot be further subdivided. <br /> d. All development shall comply with the 'Trees' Chapter of the Development Title. <br /> (Development Title Section 9-1505) <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> See attached memo from Public Works dated September 14, 1993. <br /> 3. PUBLIC HEALTH SERVICES: <br /> See attached memo from Public Health dated September 1, 1993. <br /> 4. COUNTY COUNSEL: <br /> Pursuant to Section 66474.9 of the Government Code,the subdivider shall defend, indemnify, and <br /> hold harmless the local agency or its agents, officers, and employees from any claim, action, or <br /> proceeding against the local agency or its agents, officers, or employees to attack, set aside,void, <br /> or annul an approval of the local agency, advisory agency, appeal board, or legislative body <br /> concerning a subdivision,which action is brought within the time provided for in Section 66499.37 <br /> of the Government Code. <br /> NOTE: On September 21, 1993,the San Joaquin County Community Development Department Approved <br /> MS-93-76 subject to the Conditions of Approval listed above. <br /> Conditions of Approval - 1 - MS-93-76 <br />
