Item No . 4 <br /> PC : 4-17-86 <br /> SU-86-9 <br /> Page 3 <br /> STAFF ANALYSIS <br /> POLICY CONSIDERATIONS : <br /> This application is made under the Planning Code provision which <br /> allows the creation of a homesite parcel less than the zone mini- <br /> mum for purposes of financing a residence for each member of the <br /> owner-operator ' s family who earns a substantial portion of their <br /> income from the agricultural operation. All requirements and <br /> documentation to support this provision have been presented with <br /> the application and appear to be in order . <br /> AREA/NEIGHBORHOOD COMPATIBILITY: <br /> Agricultural Compatibility: <br /> The proposal is not expected to impact on agricultural opera- <br /> tions because the homesites are grouped together and are adja- <br /> cent to Bird Road. Approximately five acres will be removed <br /> from crop production when residential dwellings are constructed <br /> on the family members ' homesites. <br /> Williamson Act : <br /> The subject property is currently under Williamson Act <br /> contract . Under the more stringent provisions of State <br /> Legislation which went into effect on January 1 , 1986 (Assembly <br /> Bill No. 1678) , a homesite under contract created for a family <br /> member requires a " . . .written agreement for joint management . . . " <br /> between the owner-operator and the family member . A prototype <br /> agreement is currently under review by County Counsel ' s office <br /> and should be applied to this application once approved. <br /> FACILITIEb/ ERVICES : <br /> No public services except electrical power are currently <br /> available. Water is proposed to be provided by individual wells , <br /> with sewage disposal by individual septic systems . Drainage is <br /> proposed to be contained onsite . <br /> Easements currently exist for the Banta-Carbona Irrigation <br /> District along Bird Road and for the New Jerusalem Drainage <br /> District along the proposed north property line of Parcel B. <br /> These easements need to be respected and building prohibited <br /> within the easement . A Banta-Carbona easement is proposed along <br /> the south property line of Parcel B. <br /> Additional development in the Tracy area will continue to impact <br /> the Tracy Public School system. Development is required to help <br />
