Item No . 4
PC : 4-17-86
SU-86-9
Page 3
STAFF ANALYSIS
POLICY CONSIDERATIONS :
This application is made under the Planning Code provision which
allows the creation of a homesite parcel less than the zone mini-
mum for purposes of financing a residence for each member of the
owner-operator ' s family who earns a substantial portion of their
income from the agricultural operation. All requirements and
documentation to support this provision have been presented with
the application and appear to be in order .
AREA/NEIGHBORHOOD COMPATIBILITY:
Agricultural Compatibility:
The proposal is not expected to impact on agricultural opera-
tions because the homesites are grouped together and are adja-
cent to Bird Road. Approximately five acres will be removed
from crop production when residential dwellings are constructed
on the family members ' homesites.
Williamson Act :
The subject property is currently under Williamson Act
contract . Under the more stringent provisions of State
Legislation which went into effect on January 1 , 1986 (Assembly
Bill No. 1678) , a homesite under contract created for a family
member requires a " . . .written agreement for joint management . . . "
between the owner-operator and the family member . A prototype
agreement is currently under review by County Counsel ' s office
and should be applied to this application once approved.
FACILITIEb/ ERVICES :
No public services except electrical power are currently
available. Water is proposed to be provided by individual wells ,
with sewage disposal by individual septic systems . Drainage is
proposed to be contained onsite .
Easements currently exist for the Banta-Carbona Irrigation
District along Bird Road and for the New Jerusalem Drainage
District along the proposed north property line of Parcel B.
These easements need to be respected and building prohibited
within the easement . A Banta-Carbona easement is proposed along
the south property line of Parcel B.
Additional development in the Tracy area will continue to impact
the Tracy Public School system. Development is required to help
