CONDITIONS OF APPROVAL <br /> MS-93-83 <br /> Harvey Properties, Ltd. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance Requirements shall be <br /> complied with prior to the approval of the Parcel Map. <br /> This approval will expire three years from the date of approval unless (1) all Conditions of Approval <br /> have been complied with and (2) a Parcel Map has been filed with and accepted by the Surveyor's <br /> Office. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance requirements. Ordinance requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. All parcels shall have a minimum width of 330 feet. (Development Title Section 9-610.2) <br /> b. Parcels 2 and 3 shall be 10-acres in size. (Development Title Section 9-610.3[aj[3[) <br /> C. The following note shall be placed on the Parcel Map and also recorded as a separate <br /> instrument: <br /> In accordance with Section 9-610.3 of the San Joaquin County Development Title for the <br /> creation of homesite parcels, these parcels cannot be further subdivided. <br /> 2. PUBLIC WORKS DEPARTMENT: <br /> See the attached memo from Public Works, dated October 12, 1993. <br /> 3. PUBLIC HEALTH SERVICES: <br /> See the attached memo from Public Health, dated September 29, 1993. <br /> 4. MOKELUMNE RURAL COUNTY FIRE PROTECTION DISTRICT: <br /> See the attached letter from Mokelumne Rural County Fire Protection District, dated <br /> September 23, 1993. <br /> 5. COUNTY COUNSEL: <br /> a. Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, <br /> indemnify, and hold harmless the local agency or its agents, officers, and employees from <br /> any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory <br /> agency, appeal board, or legislative body concerning a subdivision, which action is <br /> brought within the time provided for in Section 66499.37 of the Government Code. <br /> NOTE: On October 18, 1993, the San Joaquin County Community Development Department Approved <br /> MS-93-93 subject to the Conditions of Approval listed above. <br /> Conditions of Approval - 1 - MS-93-83 <br />
