RE: Claim Against the San Joaquin Local Health District, San Joaquin County <br />Board of Supervisors, San Joaquin County Planning Department, and <br />San Joaquin County Planning Commission <br />On July 2, 1984 the above referenced claim was received by the San Joaquin Local <br />Health District from John A. Hetherington, Attorney at law, and Mary A. Allen, <br />Attorney at law, representing claimants residing at the Santos Ranch Residential <br />Subdivision West of Tracy, CA. <br />The claimants allege that the San Joaquin Local Health District, Division of <br />Environmental Health, from 1977 to approximately 1984, negligently approved <br />several units of the Santos Ranch Residential Subdivision involving the following: <br />1. Approved private water well systems which were designed, constructed, and <br />approved in violation of County and State statutes, regulations, and ordinances. <br />(Reference pg. 4 item 1-9) <br />2. Approved private sewage systems which were designed, constructed, and approved <br />in violation of County and State statutes, regulations, and ordinances. <br />(Reference pg. 6 item 1-10) <br />3. The approvals of item 1 and 2 has resulted in overdrafted wells causing <br />unhealthy water to be introduced into the claimants wells from the sewage systems. <br />A study of Environmental Health files for the period 1977-1984 indicates that the <br />Santos Ranch Residential Subdivision was approved according to all State, County, <br />Health District statutes, ordinances, regulations, and guidelines. <br />It is recommended that the San Joaquin Local Health District Board of Trustees <br />acquire legal counsel to reject all claims alleged in this document. <br />
