This information has not been received <br /> within 30 days, resulting in a non-compliant status for this facility, a non compliance follow up letter was issued by <br /> the EHD on 3-26-2019 identifying outstanding violations. <br /> REGULATION GUIDANCE: 25404.1.2(c)(1)A person who receives a notice to comply detailing a minor violation <br /> shall have not more than 30 days from the date of the notice to comply in which to correct any violation cited in the <br /> notice to comply. Within five working days of correcting the violation,the person cited or an authorized <br /> representative shall sign the notice to comply, certifying that any violation has been corrected, and return the notice <br /> to the UPA. <br /> CORRECTIVE ACTION: Ensure that a written response documenting corrective actions taken or proposed is <br /> submitted within 30 days of receiving an inspection report. Submit proof of correction to the EHD. <br /> This is a Class II violation. <br /> 203 CFR 112.3 Failure to implement the SPCC Plan. <br /> OBSERVATION: The Spill Prevention, Control, and Countermeasure(SPCC)Plan was not implemented, as <br /> required.The following checklists, included in the reviewed SPCC plan,were not completed (not available at the <br /> time of inspection):Annual SPCC Plan Applicability Review Checklist and Annual SPCC Plan Applicability Review <br /> Table(Appendix B of the reviewed plan). Furthermore,the SPCC plan indicates that tanks and piping are observed <br /> daily and facility personnel ensures that no leaks or signs of oil discharge are present at locations where oil <br /> products are stored and that problems are corrected as soon as practicable. The dark oily liquid was observed <br /> inside an open 5-gallon container located inside the secondary berm of the onsite petroleum above ground storage <br /> tanks; a puddle of liquid with a rainbow sheen was noted inside the secondary containment in the vicinity of this <br /> 5-gallon container.Also, standing dark oily liquid was noted in a covered secondary containment trench that leads <br /> from dispensers to the above-ground petroleum storage tank. Oily staining was also observed on the ground, <br /> around the diesel dispenser with visible signs of nozzle leakage on the dispenser handle. <br /> REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section <br /> must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter"SPCC <br /> Plan"or"Plan"Y' in accordance with§ 112.7 and any other applicable section. 25270.4.5.(a):An owner or operator <br /> shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with <br /> Section 112.1)of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the <br /> spill prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of <br /> the regulations contained in Part 112 (commencing with Section 112.1)of Subchapter D of Chapter I of Title 40 of <br /> the Code of Federal Regulations. <br /> CORRECTIVE ACTION: Implement the SPCC plan, as required.
