OBSERVATION:An inspection was last done on 1-14-2019 and an inspection report was issued identifying information to be submitted to the EHD to bring this site into compliance. This information has not been received within 30 days, resulting in a non-compliant status for this facility, a non compliance follow up letter was issued by the EHD on 3-26-2019 identifying outstanding violations. REGULATION GUIDANCE: 25404.1.2(c)(1)A person who receives a notice to comply detailing a minor violation shall have not more than 30 days from the date of the notice to comply in which to correct any violation cited in the notice to comply. Within five working days of correcting the violation,the person cited or an authorized representative shall sign the notice to comply, certifying that any violation has been corrected, and return the notice to the UPA. CORRECTIVE ACTION: Ensure that a written response documenting corrective actions taken or proposed is submitted within 30 days of receiving an inspection report. Submit proof of correction to the EHD. This is a Class II violation. 203 CFR 112.3 Failure to implement the SPCC Plan. OBSERVATION: The Spill Prevention, Control, and Countermeasure(SPCC)Plan was not implemented, as required.The following checklists, included in the reviewed SPCC plan,were not completed (not available at the time of inspection):Annual SPCC Plan Applicability Review Checklist and Annual SPCC Plan Applicability Review Table(Appendix B of the reviewed plan). Furthermore,the SPCC plan indicates that tanks and piping are observed daily and facility personnel ensures that no leaks or signs of oil discharge are present at locations where oil products are stored and that problems are corrected as soon as practicable. The dark oily liquid was observed inside an open 5-gallon container located inside the secondary berm of the onsite petroleum above ground storage tanks; a puddle of liquid with a rainbow sheen was noted inside the secondary containment in the vicinity of this 5-gallon container.Also, standing dark oily liquid was noted in a covered secondary containment trench that leads from dispensers to the above-ground petroleum storage tank. Oily staining was also observed on the ground, around the diesel dispenser with visible signs of nozzle leakage on the dispenser handle. REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter"SPCC Plan"or"Plan"Y' in accordance with§ 112.7 and any other applicable section. 25270.4.5.(a):An owner or operator shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1)of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1)of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. This is a repeat violation, Class II.
