The training program say it is provided else where in CERS <br /> under the"facility information section" is wrong. The training program should say provided elsewhere in CERS <br /> under the"Emergency Response and Contingency Plan"section. <br /> REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, <br /> shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or <br /> threatened release of a hazardous material.Training shall cover, but not limited to, all of the following: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice,for the business site. <br /> These training programs may take into consideration the position of each employee. <br /> CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California <br /> Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, upload the correct or updated information, <br /> and submit to the EHD for approval. <br /> This is a repeat violation, Class ll. <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br /> OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br /> Environmental Reporting System (CERS)annually by the due date, January 15.The business plan was submitted <br /> on 11/20/2018 for the facility and inventory sections for the year of 2019. The plans section was not submitted for <br /> the year of 2019. The business plan was not submitted for the years of 2021 and 2022.The business last submittal <br /> was made on 7/30/2020. <br /> REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br /> year and may be submitted beginning November 1 of the previous year. <br /> CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br /> information, and submit to the EHD for approval. <br /> This is a repeat violation, Class ll. <br /> Overall Inspection Comments: <br /> Conducted in-office Hazardous Materials Business Plans (HMBP) inspection. The food inspector, Kadeanne <br /> Linhares, performed an on-site inspection for the CO2 tank on 1/10/2022. <br /> There were 5 violations found during the in-office inspection. Complete and submit a copy of the Return to <br /> Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or <br /> will be taken for each violation, and any supporting paperwork, by 6/5/2022. <br /> Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate ($152).
