Flexible Entry Boot environ <br /> covers when installed as part of the GeoFlex''System. <br /> This Limited Warranty shall be null and void if the products to <br /> which it applies:(a)are employed in above ground applications, <br /> (b) have been installed by anyone other than an installer trained <br /> by Seller, or in a manner which fails to conform to Seller's <br /> installation instructions,or(c) have been installed in sites where <br /> any associated underground storage tanks have not been <br /> properly anchored. <br /> II. Ten Year Product Warranty <br /> Seller warrants that all products (excepting installer tools) <br /> manufactured and sold by it which do not contain electrical <br /> components shall be of good materials and workmanship and <br /> free from functional defects for a period of ten (10) years from <br /> date of sale. Seller further warrants that all such products shall <br /> be compatible with gasoline, gasohol, ethanol, methanol, <br /> kerosene,diesel fuel and motor oil. <br /> This Limited Warranty shall be null and void if the products to <br /> which it applies:(a)are employed in above ground applications, <br /> (b) have been installed by anyone other than an installer trained <br /> by Seller, or in a manner which fails to conform to Seller's <br /> installation instructions,or(c)have been installed in sites where <br /> any associated underground storage tanks have not been <br /> properly anchored, or (d) respecting Seller's piping products, <br /> some manufacturer's tank and dispenser containers have not <br /> been contemporaneously installed. <br /> 111. One Year Product Warranty <br /> Seller warrants that all installer tools, and all products <br /> manufactured and sold by it which contain electrical <br /> components, shall be of good materials and workmanship and <br /> free from functional defects for a period of one (1) year from <br /> date of sale. <br /> This limited warranty shall be null and void if the products to <br /> which it applies: (a) have not been installed or employed by <br /> anyone other than an installer trained by Seller, or in a manner <br /> which fails to conform to Seller's installation instruction, or (b) <br /> respecting Seller's coupling machine, if another manufacturer's <br /> couplings have been employed. <br /> AS THE EXCLUSIVE REMEDY FOR ANY BREACH OF THE ABOVE <br /> LIMITED WARRANTIES, SELLER WILL REPLACE <br /> NONCONFORMING GOODS OR REFUND THE PURCHASE PRICE. <br /> THESE LIMITED WARRANTIES ARE IN LIEU OF ALL OTHER <br /> WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT <br /> LIMITED TO, THOSE CONCERNING MERCHANTABILITY OR <br /> FITNESS FOR A PARTICULAR PURPOSE. THESE LIMITED <br /> WARRANTIES ARE ALSO IN LIEU OF ANY OTHER POSSIBLE <br /> LIABILITIES OF SELLER, WHETHER ALLEGED TO ARISE BY <br /> AGREEMENT OR BY OPERATION OF LAW,RESPECTING THE SALE, <br /> INSTALLATION, USE OR FUNCTION OF SELLER'S PRODUCTS. IN <br /> NO EVENT SHALL SELLER BE LIABLE FOR EXCAVATION, <br /> REMOVAL, DOWNTIME, INCIDENTAL, RESULTING OR <br /> CONSEQUENTIAL DAMAGES. <br /> No person is authorized by Seller to assume for it any other <br /> liability of any kind in connection with the sale or use of products <br /> manufactured and sold by it, and there are no oral agreements <br /> or warranties collateral to or affecting any sale or use. <br /> 5 <br />
