OBSERVATION: This business does not have a hazardous waste ID number in the California Department of Toxic Substances Control (DTSC)database. REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of,transport or offer for transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification (ID) Number.A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID numbers are unique to a business and site location. CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ to obtain an ID number. Immediately apply for your ID number and submit evidence to the San Joaquin County Environmental Health Department within 30 days. This is a Class II violation. 105 CCR 66262.34(d)(2)No emergency coordinator available for emergency response. OBSERVATION: A complete modified contingency plan with an assigned emergency coordinator was not posted at the facility. REGULATION GUIDANCE: The emergency coordinator or his designee must respond to any emergencies that arise. The business operator must post the following information next to telephones or in areas directly involved in the generation and accumulation of hazardous waste: the name and emergency telephone number of the emergency coordinator, the location of fire extinguishers and spill control material, and the telephone number of the fire department unless the facility has a direct alarm. CORRECTIVE ACTION: This violation was corrected at the time of the inspection. This is a Class II violation. 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. OBSERVATION: The facility could not provide all of the consolidated manifest receipts for hazardous waste transported from the site in the past three years. The missing receipts are for used oil. Per Eric, he has been taking it to Kludt Oil in Lodi, CA. REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. This period of retention is extended automatically during the course of any unresolved enforcement action regarding the regulated activity or as requested by the department or a certified unified program agency. CORRECTIVE ACTION: Locate a copy of the receipts listed above. Maintain the records on-site for three years from the date of shipping and provide a copy to the San Joaquin County Environmental Health Department(EHD). If the receipts cannot be found, provide a statement to the EHD that future receipts will be maintained on-site for three years. This is a Class II violation.
