MS-88-85, WHEREBY TETRA DIAMOND DOES NOT QUALIFY <br /> TO DIVIDE PROPERTY UNDER THE PROVISIONS OF A MINOR SUBDIVISION <br /> APPLICATION AND IS REQUIRED TO SUBMIT A MAJOR SUBDIVISION <br /> APPLICATION IN ORDER TO DIVIDE A TOTAL OF MORE THAN 4 PARCELS. <br /> (DISTRICT 4 ) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors: <br /> Deny the appeal and uphold the Planning Commission action to deny <br /> MS-88-85 based on the fact that Tetra Diamond does not qualify to <br /> divide property under the provisions of a Minor Subdivision <br /> application. <br /> REASON FOR RECOMMENDATION: <br /> This proposal was determined to be complete on March 3 , 1988. After <br /> reviewing the history of earlier land division activity undertaken by <br /> Tetra Diamond Inc. and C. Norman Adams, it was determined that a Major <br /> Subdivision application would need to be processed. This proposal <br /> creates a fifth parcel and is in conflict with the State Map Act, <br /> which restricts a property owner (s ) to creating a maximum of four <br /> adjacent parcels under a Minor Subdivision. <br /> The determination that a Major Subdivision application should be <br /> required was based on the following history (refer to the Page 7 <br /> which illustrates the successive divisions ) : <br /> ° On March 9 , 1972, Mr. Norman Adams had Survey No. 22-65 recorded, <br /> which split a 20-acre parcel, with a + 50-acre remainder. At this <br /> time, no division of land application was required by local County <br /> Ordinance when all parcels were at least 20 acres in size. <br /> BOS LETTER PAGE 1 <br />
