PLANNING COMMISSION MINUTES <br /> MAY 5, 1988 <br /> ( . MINOR SUBDIVISION APPLICATION NO. MS-88-85 OF TETRA DIAMOND, INC. <br /> (C/0 C. NORMAN ADAMS ) for an appeal of the Planning Division ' s denial <br /> of Minor Subdivision Application No. MS-88-85 to divide 30.4 acres <br /> into two parcels. The denial was based on the determination that the <br /> project should be processed as a Major Subdivision. The property is <br /> located on the north side of Liberty Road, 1212 feet west of Sowles <br /> Road, north of Lockeford. (Supervisorial District 4 ) <br /> Associate Planner Wylla Satterness introduced a staff report into the <br /> record. <br /> Deputy County Counsel Sandra Affonso said that she had been contacted <br /> by Planning staff as to whether they could process this asa application or <br /> Subdivision or a Major Subdivision. She said this app <br /> create a fifth parcel and would require a Subdivision application. <br /> The applicant would be considered a single subdivider and a Major <br /> Subdivision application would be required. She said that evidence <br /> indicates that there is not "an arm' s length" between the corporation <br /> and Mr. and Mrs. Adams. <br /> PUBLIC HEARING OPENED <br /> PROPONENTS: C. Norman Adams was present and said he was present as a <br /> representative of Tetra Diamond, Inc. He said he is presently the <br /> President of the corporation. The Parcel Map was filed for Tetra <br /> Diamond and the application requiring a signature was signed by him. <br /> He said he thought that since the application was filed by Tetra <br /> Diamond that his signature would not indicate that he was the property <br /> owner. He did not sign the application as the owner of the property, <br /> but as a representative of Tetra Diamond. Tetra Diamond has only made <br /> one division and that was to split off a 3 acre parcel for Mr. Adam' s <br /> son, Ted. <br /> Mr. Adams explained that in the case of the 30-acre parcel, this <br /> property belonged to him and his wife. In 1979, they sold it to Tetra <br /> Diamond. They now have a deed of trust and a promissory note to Tetra <br /> Diamond and payments are made to him. He and his wife are share <br /> holders in Tetra Diamond. He submitted a certificate designating <br /> their proportionate share of the corporation. <br /> Mr. Adams said he objected to requirements of a Final Map. The cost <br /> of a Major Subdivision application is considerably more than the cost <br /> of a Minor Subdivision application. Mr. Adams also said that his <br /> neighbor, Mr. Edward G.
