MS-89-5 OF MARY WALTERS <br /> (C/O DON MOYER ) (DISTRICT 5 ) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors: <br /> Deny the appeal and uphold the Planning Commission action <br /> based upon the reasons given in the staff report and the <br /> reasons noted below. <br /> REASON FOR RECOMMENDATION: <br /> The proposal is to subdivide a 24 . 1-acre parcel into two parts of <br /> 3 . 0 and 21. 1 acres. The purpose of the Minor Subdivision is to <br /> allow the financing and construction of a residence for the owner <br /> of the property. <br /> The Planning Commission heard this matter at its meeting of <br /> October 6 , 1988 . After considering all written and oral testi- <br /> mony, the Commission , by a vote of 5-0 (Commissioners Carter and <br /> Gabbard were absent ) , denied the Minor Subdivision. <br /> On October 17 , 1988 , Don Moyer filed an appeal of the Planning <br /> Commission ' s action. <br /> BASIS FOR APPEAL: <br /> In his appeal, Mr. Moyer states the following: <br /> 1. "All Planning Commissioners present agreed that the <br /> applicant ' s request was a reasonable one and that they <br /> wanted to find a way to grant it. Because the owner has <br /> leased the bulk of her land to a Christmas tree operator , <br /> the Commission was not able to determine that she <br /> qualified as an owner-operator . Still wanting to enable <br /> the owner to proceed, the Commission voted unanimously to <br /> BOS LETTER PAGE 1 <br />
