IN <br /> PC : 10-6-88 <br /> MS-89-5 <br /> STAFF ANALYSIS <br /> BACKGROUND: <br /> The review procedure for Minor Subdivisions is normally Staff <br /> Review With Notification. Due to policy interpretations , <br /> Planning staff has referred the application to the Planning <br /> Commission. <br /> POLICY CONSIDERATIONS : <br /> Section 9-4104 (b) ( 1 ) of the Planning Title states that "one ( 1 ) <br /> parcel of land may be created for the purpose of financing a <br /> residence for not more than one ( 1 ) owner-operator of an agri- <br /> cultural enterprise . " An owner-operator is defined as "an indi- <br /> vidual , firm, association, syndicate, partnership, or corporation <br /> having sufficient proprietary interest in property to exert <br /> direct control over its use and development and in its day-to-day <br /> operation. " (Section 9-3115 . 2 ) <br /> Staff was informed that the current agricultural enterprise is a <br /> Christmas tree farm. This operation is farmed by someone other <br /> than the owner/applicant . The applicant is not a farmer , and <br /> documentation that the owner exerts control over the day-to-day <br /> operations of the Christmas tree farm was not provided. The <br /> owner is currently living in an existing residence on the pro- <br /> perty and intends to live in a new home on the homesite parcel <br /> shoud the application be approved. The owner ' s sister , who is <br /> also not involved in the operation of the tree farm, would then <br /> move into the existing residence. <br /> In response to the Planning Division' s request for documents <br /> which would substantiate owner-operator status, copies of a water <br /> bill from the South San Joaquin Irrigation District , a cancelled <br /> personal check from the property owner for half the total amount <br /> of $69 . 66 , and a letter from the owner of Manteca Feed and Supply <br /> were received (attached) . The water bill does not indicate <br /> control over day-to-day operations, and the purchase of animal <br /> feed is not considered an integral part of a tree farming opera- <br /> tion. Therefore , neither the documentation provided nor infor- <br /> mation contained in the application were sufficient to verify the <br /> applicant ' s status as owner-operator of the agricultural <br /> enterprise . <br /> ENVIRONMENTAL CONSIDERATIONS : <br /> An Initial Study was prepared for this project on September 6 , <br /> 1988 , and no significant effects on the environment were iden- <br /> tified. <br /> -9- <br />
