Item No. 5 <br /> PC : 10-6-88 <br /> MS-89-6 <br /> Page 1 <br /> RECOMMENDATION <br /> It is recommended that the Planning Commission deny the Minor <br /> Subdivision based on the inability to make Findings No . 1 , 2 , and <br /> 4 . <br /> FINDINGS <br /> 1 . "The proposed map is consistent with applicable general and <br /> specific plans as specified in Section 65451 of the <br /> Subdivision Map Act . " <br /> ° This finding cannot be made because the proposal is <br /> contrary to the provisions of the GA-40 zone, which is the <br /> implementing zone for the General Plan. Specifically, the <br /> application does not meet the intent of provisions for <br /> creating a homesite parcel . The proposal also is not con- <br /> sistent with the agricultural policy of the General Plan <br /> which discourages further fragmentation of agricultural <br /> land. There are no applicable Specific Plans . <br /> 2 . "The design or improvement of the proposed subdivision is <br /> consistent with applicable general and specific plans . " <br /> ° This finding cannot be made because the applicant has <br /> failed to adequately demonstrate owner-operator status of <br /> the property. There are no applicable Specific Plans. <br /> 3 . "The site is physically suitable for the type of development . " <br /> ° This finding can be made because the parcel can accommodate <br /> all necessary facilities on-site . <br /> 4. "The site is physically suitable for the proposed density of <br /> development . " <br /> ° This finding cannot be made because evidence indicates that <br /> the owner does not qualify as an owner-operator , and <br /> further fragmentation of the parcel will reduce the agri- <br /> cultural value of the property. <br /> 5 . "The design of the subdivision or the proposed improvements <br /> are not likely to cause substantial environmental damage or <br /> substantially and avoidably injure fish or wildlife or their <br /> habitat . " <br /> This finding can be made because an Initial Study prepared <br /> for the project did not identify any rare or endangered <br />
