Provide a <br /> corrective action statement to the San Joaquin County Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: The new motor oil tank outside on the side of the shop was observed with a leak on the hose. New <br /> oil has dripped down the side of the hose and tank and onto the bottom of the tank into the secondary containment. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately fix the leak in the hose for the new oil tank and clean the accumulated release <br /> under the tank. Manage the waste according to Title 22 California Code of Regulations for hazardous waste. <br /> Submit a statement and supporting documentation to the San Joaquin County Environmental Health Department <br /> describing the storage and final disposition of the cleaned up waste. <br /> This is a Class II violation. <br /> 403 CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> OBSERVATION: The following open hazardous waste storage containers were observed on-site: <br /> -one tank of used oil was observed outside on the side of the shop with an open port <br /> REGULATION GUIDANCE:A container holding hazardous waste shall always be closed during transfer and <br /> storage, except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: Immediately obtain a way to close this container and ensure all hazardous waste <br /> containers are closed when not adding or removing waste. Provide a corrective action statement and supporting <br /> documentation to the San Joaquin County Environmental Health Department within 30 days. <br /> This is a minor violation. <br /> Overall Inspection Comments: <br /> An inspection report was provided to the facility operator on the day of inspection. Item#119 observation and <br /> corrective action details were amended to describe what was not reported in CERS.
