FINDINGS/DETERMINATIONS <br />Description of physical characteristics and chemical composition of the hazardous <br />waste to which this variance applies: CESQG hazardous wastes will be transported <br />under this variance. Explosives, radioactive wastes (except smoke detectors/alarms), <br />compressed gas cylinders, and unstable chemicals will not be accepted. <br />Federal regulatory provisions which allow this variance: Section 261.5 of Title 40, <br />Code of Federal Regulations (40 CFR), grants a conditional exemption for small quantity <br />generators who generate no more than 100 kilograms of hazardous waste in a month and <br />who accumulate less than 1000 kilograms of hazardous waste onsite at any one time. <br />There is no comparable registration requirement for transporters of hazardous waste in <br />40 CFR. <br />
