Box 1810 Stockton, California 94201 Gray Davis Governor HHWVAR010202 -- VARIANCE AUTHORIZING SAN JOAQUIN COUNTY TO OPERATE A MATERIALS EXCHANGE PROGRAM (MEP) AT THE SAN JOAQUIN COUNTY TRANSFER FACILITY Dear Ms. Hudson: This letter is in response to San Joaquin County Department of Public Works' request for a variance to operate an MEP at the San Joaquin County Transfer Facility located at 2323 East Lovelace Road, Manteca. San Joaquin County proposes to deliver usable household products/materials to a central location for the purpose of reissuance to the public, thereby reducing landfill volumes. The Department of Toxic Substances Control (DTSC) has completed its review of your January 29, 2001 request for a variance to operate the MEP site. Based on the information contained in your submittal the Department of Toxic Substances Control (DTSC) is granting a variance to San Joaquin County Department of Public Works subject to the conditions and limitations set forth in the attached document. Pursuant to the Health and Safety Code (HSC), section 25205.3, household hazardous waste collection facilities operated by local government agencies are exempt from all fees imposed by HSC, Article 9.1. Therefore, no fees will be assessed for the operation of these authorized collection activities. The energy challenge facing California is real.
