500 E Louise Ave <br /> Lathrop, San Joaquin County -6 - 12 April 2019 <br /> REQUIRED ACTIONS <br /> IT IS HEREBY ORDERED that, pursuant to Water Code section 13267 and prior to any <br /> further construction or earthmoving activities, the Responsible Parties shall: <br /> 1. Within 7 days of the issuance of this Order, submit, submit a Site Activity Report: <br /> a) Detailing the construction and earth moving activities on the eastern portion of <br /> the Site including: construction plans for the area of disturbance, the locations <br /> and extents of waste material found, waste handling, all sample collection <br /> locations and analyses, storage and disposal activities, details of the removal <br /> of the empty oil tank and surrounding berm, details of the pipe installation near <br /> the diesel site. <br /> b) Detail release(s) of potential threats to human health and the environment <br /> including the presence of random unpermitted waste pits and diesel spill <br /> cleanup site. <br /> 2. Within 14 days from the submittal of the Site Activity Report, submit a Work Plan: <br /> a) Containing a scope of work that provides appropriate Site characterization <br /> including: exploratory trenching investigation of the eastern portion of the Site <br /> for other unpermitted waste pits, analytical laboratory testing of waste samples <br /> and soil samples collected from beneath the waste for Site COCs, groundwater <br /> sampling and analysis for Site CDCs, waste handling and management, and <br /> proposed disposal of waste material. <br /> b) To address and mitigate potential threats to human health and the environment <br /> including the presence of random unpermitted waste pits and work conducted <br /> in the vicinity of diesel spill cleanup site, which are open remediation cases at <br /> the property. <br /> Failure to submit required reports to the Central Valley Water Board, and in conformity with the <br /> schedule set forth above, may result in enforcement action resulting in administrative civil <br /> liability of up to $1,000 per day of noncompliance, pursuant to Water Code 13268. The Central <br /> Valley Water Board further reserves its right to take any additional enforcement actions <br /> authorized by law. <br /> Responsible Parties shall submit electronic copies of documents and electronic data required by <br /> this Order to the State Water Board's Geographic Environmental Information Management <br /> System (GeoTracker) database system at http://geotracker.waterboards.ca.gov. Electronic <br /> submittals shall conform to the requirements of the California Code of Regulations, Title 23, <br /> Division 3, Chapter 30, and also with GeoTracker standards and procedures as specified on the <br /> State Water Board's web site. <br /> Pursuant to Business and Professions Code sections 6735, 7835 and 7835.1, Responsible <br /> Parties shall have appropriate reports: prepared by, or under the supervision of, a California- <br /> licensed engineer, geologist, or specialty geologist; and signed and stamped by a California- <br /> licensed engineer, professional geologist, or licensed, certified specialty geologist. All technical <br /> reports submitted under this Order shall include a coverleter signed by the submitting <br />
