Ikont,.l <br />Water Boards <br />Central Valley Regional Water Quality Control Board <br />17 December 2018 <br />Troy Estaclo <br />Buzz Oates Construction Company <br />555 Capital Drive <br />Sacramento, Ca, 95814 <br />COMFORT LETTER REGARDING PROPERTYAT FORMER PILKINGTON NORTH <br />AMERICA, 17100 MURPHY PARKWAY (APN 198-120-090), L.A THROP, SAN JOAQUIN <br />COUNTY <br />California Central Valley Regional Water Quality Control Board (Regional Water Board) staff <br />received your 5 AprIl 2017 C(ean Closure end Post Closure Land 1./se Plan (Closure Request) <br />and responded in a 28 September 2018 staff letter Comments on Di -aft Request for Clean <br />Closure and Proposed Post Closure Land Use Plan and subsequent letters in support of the <br />path to closure for the site located at 17100 Murphy Parkway (APN 198-120-09) in Lathrop, San <br />Joaquin County (the Site"). The approved closure Includes redevelopment of the property to <br />maintain commercial/industrial land use by constructing a large warehouse (870000 square - <br />foot) arid accompanying parking lot. The Site was formerly a part of the Former Plikington North <br />America property located at 500 East Louise Ave and was recently purchased by Buzz Oates <br />Construction, LLC to continue with the pianned redevelopment. <br />The Site historically contained three unpermitted landfills that primarily received broken glass <br />and other wastes generated by the former glass factory during manufacturing operations by the <br />former Pilklrigton North America (PNA) and its predecessor Libby Owens Ford. Site <br />investigations have Identified metals, total petroleum hydrocarbons, total dissolved solids <br />polychlorinated biphenyis, semi -volatile organic compounds, dioxin and furans as constituents <br />of concern, Each former landfill cell was excavated with approved confirmation sampling, waste <br />disposal, and backfiillng with approved fill material. Two of the former landfill cells, located along <br />the property boundary with the neIghboring San ,Joaquln Cogerieration Plant (SJCP), were <br />defined, excavated and backililed to the property line leaving waste in place along their shared <br />property line where the former North and South Waste Cells extend onto the SJCP property, <br />Due to these two waste cells having walls on the property line with waste extending from tile <br />property line into the neighboring former SJCP, the cells are not eligible for a No Further Action <br />(NFA) letter until the waste Is addressed at the neighboring property. Regional Water Board <br />staff have requested the neighboring property owner begin investigation of the waste cells <br />extending onto their property for remediation. Regional Water Board staff are currently <br />reviewing a work plan to begin site assessment field work at the SJCP. <br />California Water Code section 13304 authorizes Regional Boards, among other provisions, to <br />order any person who causes or permits waste to be discharged where it 'creates, or threatens <br />to create, a condition of pollution or nuisance" to clean up the waste or abate the effects of the <br />KAnt E. tOnaLly LcD.
