Order <br />2009-0009-DWQ amended by 2010-0014-DWQ & 2012-0006-DWQ <br /> 12 <br />71. This General Permit establishes a 10 year, 24 hour (expressed in <br />inches of rainfall) Compliance Storm Event exemption from the <br />technology-based numeric effluent limitations for ATS discharges. <br />Exceedances of the ATS turbidity NEL constitutes a violation of this <br />General Permit. <br /> <br />L. Post-Construction Requirements <br /> <br />72. This General Permit includes performance standards for post- <br />construction that are consistent with State Water Board Resolution No. <br />2005-0006, "Resolution Adopting the Concept of Sustainability as a <br />Core Value for State Water Board Programs and Directing Its <br />Incorporation," and 2008-0030, “Requiring Sustainable Water <br />Resources Management.“ The requirement for all construction sites to <br />match pre-project hydrology will help ensure that the physical and <br />biological integrity of aquatic ecosystems are sustained. This “runoff <br />reduction” approach is analogous in principle to Low Impact <br />Development (LID) and will serve to protect related watersheds and <br />waterbodies from both hydrologic-based and pollution impacts <br />associated with the post-construction landscape. <br /> <br />73. LUP projects are not subject to post-construction requirements due to <br />the nature of their construction to return project sites to pre- <br />construction conditions. <br /> <br />M. Storm Water Pollution Prevention Plan Requirements <br /> <br />74. This General Permit requires the development of a site-specific <br />SWPPP. The SWPPP must include the information needed to <br />demonstrate compliance with all requirements of this General Permit, <br />and must be kept on the construction site and be available for review. <br />The discharger shall ensure that a QSD develops the SWPPP. <br /> <br />75. To ensure proper site oversight, this General Permit requires a <br />Qualified SWPPP Practitioner to oversee implementation of the BMPs <br />required to comply with this General Permit. <br /> <br />N. Regional Water Board Authorities <br /> <br />76. Regional Water Boards are responsible for implementation and <br />enforcement of this General Permit. A general approach to permitting <br />is not always suitable for every construction site and environmental <br />circumstances. Therefore, this General Permit recognizes that <br />Regional Water Boards must have some flexibility and authority to <br />alter, approve, exempt, or rescind permit authority granted under this
