Order <br />2009-0009-DWQ amended by 2010-0014-DWQ & 2012-0006-DWQ <br /> 16 <br />Existing dischargers shall electronically file their PRDs no later than <br />July 1, 2010. If an existing discharger’s site acreage subject to the <br />annual fee has changed, it shall mail a revised annual fee no less <br />than seven days after receiving the revised annual fee notification, <br />or else lose permit coverage. All existing dischargers shall be <br />exempt from the risk determination requirements in Section VIII of <br />this General Permit until two years after permit adoption. All <br />existing dischargers are therefore subject to Risk Level 1 <br />requirements regardless of their site’s sediment and receiving water <br />risks. However, a Regional Board retains the authority to require <br />an existing discharger to comply with the Section VIII risk <br />determination requirements. <br /> <br />5. The discharger is only considered covered by this General Permit upon <br />receipt of a Waste Discharger Identification (WDID) number assigned <br />and sent by the State Water Board Storm water Multi-Application and <br />Report Tracking System (SMARTS). In order to demonstrate <br />compliance with this General Permit, the discharger must obtain a <br />WDID number and must present documentation of a valid WDID upon <br />demand. <br /> <br />6. During the period this permit is subject to review by the U.S. EPA, the <br />prior permit (State Water Board Order No. 99-08-DWQ) remains in <br />effect. Existing dischargers under the prior permit will continue to have <br />coverage under State Water Board Order No. 99-08-DWQ until this <br />General Permit takes effect on July 1, 2010. Dischargers who <br />complete their projects and electronically file an NOT prior to July 1, <br />2010, are not required to obtain coverage under this General Permit. <br /> <br />7. Small Construction Rainfall Erosivity Waiver <br /> <br />EPA’s Small Construction Erosivity Waiver applies to sites between <br />one and five acres demonstrating that there are no adverse water <br />quality impacts. <br /> <br />Dischargers eligible for a Rainfall Erosivity Waiver based on low <br />erosivity potential shall complete the electronic Notice of Intent (NOI) <br />and Sediment Risk form through the State Water Board’s SMARTS <br />system, certifying that the construction activity will take place during a <br />period when the value of the rainfall erosivity factor is less than five. <br />Where the LRP changes or another LRP is added during construction, <br />the new LRP must also submit a waiver certification through the <br />SMARTS system. <br /> <br />If a small construction site continues beyond the projected completion <br />date given on the waiver certification, the LRP shall recalculate the
