FINDINGS FOR SITE APPROVAL <br /> PA -2200038 <br /> INDERJIT SINGH DEHAL / INDERJIT SINGH DEHAL <br /> 1 . The proposed use is consistent with the goals , policies , standards , and maps of the General Plan , any <br /> applicable Master Plan , Specific Plan , and Special Purpose Plan , and any other applicable plan <br /> adopted by the County . <br /> • This finding can be made because the Truck Sales and Services - Parking Use Type may be <br /> conditionally permitted in the I -W ( Warehouse ) zone with an approved Site Approval <br /> application . The I -W zone implements the General Plan ' s I / L ( Limited Industrial ) designation . <br /> The subject parcel has a General Plan designation of I / L and is zoned I -W . Therefore , the <br /> use is consistent with the goals , policies , standards , and maps of the General Plan . The City <br /> of Lathrop has an approved plan called the North Lathrop Transportation Fee ( NLTF ) which <br /> requires a fee to be paid for projects based on new vehicle trips . This fee was only adopted <br /> by the City of Lathrop City Council and was never adopted by the San Joaquin County Board <br /> of Supervisors . Therefore , the NLTF is not applicable to development projects within the <br /> boundaries of unincorporated San Joaquin County . There are no Master Plans , Specific <br /> Plans , and /or Special Purpose Plans adopted by San Joaquin County in the project vicinity . <br /> 2 . Adequate utilities , roadway improvements , sanitation , water supply , drainage , and other necessary <br /> facilities have been provided , and the proposed improvements are properly related to existing and <br /> proposed roadways . <br /> • This finding can be made because adequate utilities , access roads , sanitation , drainage , <br /> and other necessary facilities have been provided or are proposed and the improvements <br /> are properly related to existing and proposed streets and highways . The project site is <br /> unmanned . Therefore , water and wastewater facilities are not required . The project <br /> proposes a storm pond for stormwater drainage , the feasibility of which will be determined <br /> by the Department of Public Works . Any road improvements will be properly related to the <br /> site and roadway . Although the City of Lathrop responded to the project with comments <br /> requesting collection of the NLTF fee , this fee was only adopted by the City of Lathrop City <br /> Council and was never adopted by the San Joaquin County Board of Supervisors as <br /> required by Government Code 66002 ( b ) . This code states that capital improvement plans <br /> must be adopted by , and annually updated by , the local jurisdiction and adopted at a noticed <br /> public hearing . Therefore , the NLTF is not applicable to development projects within the <br /> boundaries of unincorporated San Joaquin County . <br /> 3 . The site is physically suitable for the type of development and for the intensity of development . <br /> • This finding can be made because the 0 . 66 - acre project site is of adequate size and shape <br /> to accommodate the proposed use , and all yards , building coverage , setbacks , parking <br /> areas and other requirements of the Development Title , as depicted on the Site Plan . <br /> 4 . Issuance of the permit will not be significantly detrimental to the public health , safety , or welfare , or be <br /> injurious to the property or improvements of adjacent properties . <br /> • This finding can be made because the project has been conditioned to meet San Joaquin <br /> County development regulations that protect public health , safety , and welfare and ensure <br /> the project is not injurious to adjacent properties . There was an Air Impact Assessment <br /> performed for the project which was reviewed by the San Joaquin Valley Air Pollution <br /> Control District ( SJVAPCD ) , which resulted in mitigation measures . These measures have <br /> been incorporated into the project ' s Mitigation Monitoring and Reporting Program ( MMRP ) . <br /> Additionally , the Initial Study prepared for this project found no potentially significant <br /> environmental impacts that could not be mitigated to a less than significant impact . <br /> PA-2200038 — Findings 1 <br />
