COMPLAINT INSPECTION REPORT <br />10:02 am <br /> 9:43 am <br />Time Out: <br />Time In: <br />Environmental Health Department <br />Name of Facility: CARNICERIA ROSITA Date: 06/09/2022 <br />Address: 2354 EAST ST, TRACY 95376 <br />Owner/Operator: I & M MARKET CORPORATION Telephone: (209) 879-9756 <br />Program Element: 1600 - FOOD PROGRAM Complaint #: CO0054957 <br />Responsible Party Contact: (209) 321-9125 <br />DESCRIPTION OF COMPLAINT ALLEGATIONS <br />The San Joaquin County Environmental Health Department received the following complaint: <br />CO0054957 states: "SPOILED RE-FRIED BEANS (PURCHASED TWICE ON DIFFERENT OCCASIONS)." <br />VIOLATIONS AND CORRECTIVE ACTIONS <br />Items listed on this report as violations do not meet the requirements set forth in the California Health and Safety Code commencing with section 7; <br />113700. All violations must be corrected within specified timeframe. Violations that are classified as "MAJOR" pose an immediate threat to public health <br />and have the potential to cause foodborne illness. All major violations must be corrected immediately. Non-compliance may warrant immediate closure of <br />the food facility. <br /> #7 Hot and Cold Holding Temperatures <br />OBSERVATIONS: The bus tub of pinto beans is 47F. Maintain cold food at 41F or below. Correct today. <br />CALCODE DESCRIPTION: Potentially hazardous foods shall be held at or below 41/ 45°F or at or above 135°F. Owner states that the customer purchased the refried beans on <br />Saturday and then brought them back on Monday and requested a refund. Owner states that the beans were warm and he <br />questioned the complainant if the beans had been refrigerated. The complainant then became argumentative. Owner states <br />that no other similar complaints have been received. <br />Per owner, seasoned & cooked pinto beans are blended, oil is added and then the beans are refried. The beans then go to <br />the steam table. The refried beans at the steam table are changed out 7-8 times per day (used in many dishes). Owner states <br />that any left over refried beans at the end of the day are discarded (are not cooled and then re-heated). <br />We discussed proper cooling techniques. Per owner, the large tubs are not stacked in the walk-in cooler.
