(Part A): Mitigation for <br /> loss of Swainson's hawk foraging habitat may be <br /> satisfied by participation in the Mountain House HMP; <br /> fee participation in a County-sponsored multi-species <br /> conservation program or similar effort;by other <br /> programs as approved by San Joaquin County; <br /> payment to DFG of a mitigation fee under applicable <br /> DFG regulations and/or guidelines which may be in <br /> effect at the time mitigation is undertaken;or by a <br /> combination of all or any of the above elements. (See <br /> Swainson's Part B. below) <br /> 822 7.3.3.I.a Hawk Y See#804 COA-33 <br /> Part B: The mitigation measures and policies proposed <br /> within the Master Plan represent the County's current <br /> understanding of its legal rights and obligations under <br /> existing law,and are proposed with the recognition <br /> that both the biological and legal status of the <br /> Swainson's Hawk are subject to sudden and <br /> unpredictable change during the planning and <br /> implementation of the project. For example, during <br /> the preparation of the Habitat Management Plan <br /> (HMP)as well as the Master Plan and Specific Plan 1, <br /> an additional Swainson's Hawk sighting occurred <br /> south of Byron Road,necessitating changes in the <br /> HMP,the Master Plan and Specific Plan 1. It is also <br /> possible that during implementation of the project,the <br /> Swainson's Hawk could be removed from the <br /> Swainson's California Endangered Species List.
