Protection and <br /> removal of nest sites within the Master Plan area are <br /> subject to the following measures: (I) Eucalyptus <br /> Tree Nest Site. It is anticipated that project <br /> development will result in the removal of the one <br /> nesting tree(discovered in spring 1994) located south <br /> of Byron Road. Upon acceptance of the HMP by the <br /> County,this eucalyptus tree may be removed at any <br /> time so long as Swainson's hawk do not occupy the <br /> tree and fledglings are not dependent upon the nest <br /> habitat(which shall be confirmed in writing by a <br /> qualified biologist). If this eucalyptus tree is not <br /> removed, it shall be subject to the measures described <br /> below. <br /> (2) Protection of Nest Trees(Other than Along Old <br /> River). If the Swainson's hawk is nesting in any tree <br /> within the Master Plan area,other than trees along the <br /> Old River,no disturbance,construction,or other <br /> project-related activities which may cause nest <br /> Swainson's abandonment or forced fledging shall occur within 1/2 <br /> 829 7.3.3.1.d Hawk mile of such tree between March 11 and August 15,or NA No nest trees on the Neighborhood"F"site. NA <br /> Agricultural Impact Fee.
