The initial study has not identified any mitigation measures or alternatives previously <br /> found not to be feasible would in fact be feasible, and would substantially reduce one or <br /> more significant effects of the project. Nor have any mitigation measures or alternatives <br /> which are considerably different from those analyzed in the previous MEIR been <br /> identified that would substantially reduce one or more significant effects on the <br /> environment. <br /> In summary,the new geological and updated traffic and noise information does not result <br /> in new significant effects not discussed in the MSIR. The traffic impacts identified in the <br /> updated traffic study are equivalent or lower in impact in 22 of 24 arterial road segments. <br /> While higher impacts were identified along two road segments, the general effects of <br /> cumulative development were discussed in the MEIR and the two road segments will be <br /> mitigated on a similar basis as other road segment mitigations (See chapters 4.12 and 6 of <br /> the MEIR). Noise impacts of traffic were discussed in the MEIR (see chapter 4.14 of the <br /> MEIR)which required additional noise studies for Specific Plans or Development Plans. <br /> The outcome of such noise studies with its recommendations for raised mitigation <br /> measures, is therefore within the mitigation of the EIR and not new impacts. The new <br /> geological information about the Great Valley Fault Zone does not result in new impacts <br /> for impacts resulting from seismic events were discussed in the MEIR and its mitigation <br /> measures are sufficient to mitigate the potential impacts of the fault. (See chapter 4.6 of <br /> the MEIR). The County finds these conclusions constitute substantial evidence that the <br /> 1994 Master EIR is still appropriate for use for evaluating the Neighborhood F Project. <br /> In addition,the County received comments from others concerning the 1994 Master EIR, <br /> the Initial Study and the Neighborhood F Project. The Planning Department and <br /> independent consultant preparing the Initial Study reviewed all of these comments. <br /> According to the Planning Department and the independent consultant none of the <br /> comments received constituted evidence of changed circumstances leading to major <br /> revisions of the 1994 Master EIR because of new significant environmental effects that <br /> were not address in the 1994 Master EIR or impacts which were substantially increased <br /> in severity. <br /> Concerning the comments received by the County regarding impacts to Old River or <br /> other waters of the State associated with the discharge of tertiary treated effluent into Old <br /> River, the County performed and certified an Initial Study and Mitigated Negative <br /> Declaration in 1999 (SCH 98032047),hereinafter referred to as 1999 Mitigated Negative <br /> Declaration. The 1999 Mitigated Negative Declaration evaluated the environmental <br /> effects to waters of the State and specifically Old River of issuing a Conditional Use <br /> Permit for a phased and full build-out wastewater treatment plant facility. In addition,the <br /> 1999 Mitigated Negative Declaration evaluated the environmental effects of discharging <br /> tertiary treated wastewater both onto land within the community, as well as conversion to <br /> a direct river discharge when determined to be appropriate under State and Federal Law, <br /> based on actual field tests. <br /> 22 <br />
