State and Federal storm water management standards in accordance with the California <br /> Municipal Storm Water BMP Manual. The County further finds that the Storm Water <br /> Master Plan adopted by the CSD provides a plan which maintains the ability of the CSD <br /> to address pending and future TMDL objectives as well as data on BMP effectiveness for <br /> non-point pollutant source management and treatment. <br /> The County finds that a stone water plan has been prepared and approved by the CSD <br /> which addresses the interim storm water protection needs of the Neighborhood F Project, <br /> which is consistent with the policies and requirements for storm protection included in <br /> the Mountain House Master Plan for phased projects as well as State and Federal <br /> guidelines for management,non-point source treatment and discharge. All construction <br /> projects anticipated for implementation of the entire Master Plan will be subject to <br /> CVRWQCB standards and regulations for control of construction related sedimentation <br /> and must comply with standards through the preparation of a Stormwater Pollution <br /> Prevention Plan as required under the Board's National NPDES Permit. The County <br /> finds that the Storm Water Report and subsequent analysis contained in the Initial Study <br /> and Mitigated Negative Declaration prepared for the Neighborhood F Project proposes <br /> that both the permanent improvements consistent with the CSD adopted Storm Water <br /> Master Plan for the Community, and interim improvements to serve the subdivision area <br /> are consistent with the standards and policies contained in the Master Plan,the <br /> mitigations addressed in the MEIR and Mitigated Negative Declaration for the <br /> subdivision. Improvements are proposed to collect and convey storm water through both <br /> an interim water quality basin and then ultimately to areas for ponding on lands <br /> controlled through easement by the CSD behind the Old River levee. As such, course <br /> sediment can be given the opportunity to settle,and that storm water can be metered <br /> under the control of the CSD out to Old River. These interim improvements will remain <br /> in effect until full Mountain House Creek improvements are constructed to allow direct <br /> discharge into Old River. The full Mountain House Creek improvements permitting <br /> direct discharge into Old River will be constructed pursuant to the CSD's Storm Water <br /> Master Plan, and in accordance with-requirements established by the Corps of Engineers <br /> and guidelines and standards set by the CVRWQCB. <br /> Concerning comments received by the County regarding potential impacts to protected, <br /> threatened and endangered species, the County finds that the 1994 Master EIR adequately <br /> addressed environmental effects of the Mountain House project to wildlife and wildlife <br /> habitat. The County prepared and approved a Mountain House Habitat Management Plan <br /> (HMP) for the Mountain House project and the project is obligated to either satisfy the <br /> requirements of the Mountain House HMP or otherwise participate in the Countywide <br /> San Joaquin Multi Species Habitat Conservation Plan ("SJMSCP")that has been <br /> developed by the San Joaquin County Council of Governments. The 1994 Master EIR's <br /> analysis of wildlife and wildlife habitat and the Mountain House HMP were subject to <br /> litigation. Independently,the California Department of Fish& Game and the <br /> International Brotherhood of Pipefitters challenged the certification of the 1994 Master <br /> EIR and validity of the Mountain House HMP (San Joaquin County Superior Court <br /> California Department of Fish& Game v. San Joaguin County,Docket No. 282812 and <br /> Plumbing & Pil2efitting Industry et al. v. San Joaquin County,Document 282773). The <br /> 24 <br />
