Analysis of the new cumulative growth information has shown that some roadway <br /> segments have improved levels of service that now require no mitigation improvements <br /> for 2010. However, it is expected that these improvements will still be needed in the <br /> future beyond 2010. The Master Plan and MEIR require a full traffic impact analysis for <br /> each subsequent Specific Plan; and at that time, additional traffic studies will be prepared <br /> for cumulative traffic impacts with an expanded time frame. <br /> An updated noise study for Neighborhood F was prepared using the updated traffic data <br /> in compliance with MEIR mitigation measure4.14-1. The noise study showed increased <br /> 60 and 65 db noise contours for Mascot Boulevard, De Anza Boulevard and Mountain <br /> House Boulevard. As a result, higher noise walls or greater setbacks than originally <br /> adopted are needed. Such new information was required by the MEIR to refine the <br /> general noise mitigation identified in the MEIR and previous SEIR. The proposed noise <br /> mitigation measures for Neighborhood F thereby fine tune previous mitigation measures <br /> and do not constitute new information of substantial importance requiring preparation of <br /> a supplemental or subsequent EIR. <br /> The initial study has not identified any mitigation measures or alternatives previously <br /> found not to be feasible would in fact be feasible, and would substantially reduce one or <br /> more significant effects of the project. Nor have any mitigation measures or alternatives <br /> which are considerably different from those analyzed in the previous MEIR been <br /> identified that would substantially reduce one or more significant effects on the <br /> environment. <br /> In summary,the new geological and updated traffic and noise information does not result <br /> in new significant effects not discussed in the MEIR. The traffic impacts identified in the <br /> updated traffic study are equivalent or lower in impact in 22 of 24 arterial road segments. <br /> While higher impacts were identified along two road segments,the general effects of <br /> cumulative development were discussed in the MEIR and the two road segments will be <br /> mitigated on a similar basis as other road segment mitigations (See chapters 4.12 and 6 of <br /> the MEIR. Noise impacts of traffic were discussed in the MEIR(see chapter 4.14 of the <br /> MEIR) which required additional noise studies for Specific Plans or Development Plans. <br /> The outcome of such noise studies with its recommendations for raised mitigation <br /> measures is therefore within the mitigation of the EIR and not new impacts. The new <br /> geological information about the Great Valley Fault Zone does not result in new impacts <br /> for impacts resulting from seismic events were discussed in the MEIR and its mitigation <br /> measures are sufficient to mitigate the potential impacts of the fault. (See chapter 4.6 of <br /> the MEIR). <br /> III.D. Finding: Based upon a review of the whole record,the County finds that there is <br /> no substantial evidence that the Neighborhood F Project will have a significant effect on <br /> the environment and that Mitigated Negative Declaration reflects the County's <br /> independent judgment and analysis. <br /> CEQA Requirements: CEQA Guidelines Section 15074 states: (b) Prior to approving a <br /> project, the decision making body of the lead agency shall consider the proposed <br /> 31 <br />
