Hazelton Avenue <br /> Stockton,California 95205-6232 <br /> Re: Tract 2925 Conditions of Approval-Provision of Community Servies <br /> Dear Michael: <br /> This correspondence is sent to memorialize the agreements reached between Trimark <br /> Communities and Community Development Staff with regard to the fulfillment of Master Plan <br /> and Specific Plan I community facility obligations, specifically relating to Fire protection, <br /> Community Parks and OId River early access,as discussed in the Master Plan and Specific Plan 1. <br /> To fulfill these obligations, Trimark Communities proposes that specific provisions which are <br /> triggered by a residential construction timing event which occurs beyond the total number of units <br /> to be constructed in Neighborhood F, to be triggered by a specific subsequent event in the <br /> following Neighborhood. <br /> Specifically, the Neighborhood F Map will include 1,458 residential units. Three specific facility <br /> provisions are triggered at either 1,800 or 2,000 units respectively_ Because Neighborhood F will <br /> never reach these specific triggers, it was agreed that Community Development would <br /> subsequently add conditions to the next Neighborhood subdivision following F, that required <br /> these facilities when the balance of the trigger units is to be met (i.e. 342 units or 542 units). <br /> Accordingly, we propose that the following draft language be used by Staff on the conditioning of <br /> the second neighborhood subdivision within Mountain House to satisfy the Master Plan and <br /> Specific Plan I requirements for the following facilities. <br /> 1. First Permanent Fire Station (Required at 1800 Units)— Prior to the issuance of <br /> the 342ad Certificate of Occupancy for a residential unit contained within the next <br /> Neighborhood subdivision following Neighborhood F (currently anticipated to be <br /> Neighborhood E), the first permanent Fire Station she be provided, in accordance <br /> with Master Plan,Specific Plan I, and CSD Fire Protection Plan requirements. <br /> 2.
