J <br /> SUPPLEMENTAL FINDINGS <br /> COUNTY OF SAN JOAQUIN <br /> SUPPORT OF THE NEIGBORHOOD F TENTATIVE <br /> SUBDIVISION MAP. <br /> The County of San Joaquin considered the entire record of the proceedings concerning <br /> the Neighborhood F Tentative Subdivision Map application (Map) and makes the <br /> following findings: <br /> 1. The Map application was deemed complete on 4/27/2000. All required public hearings <br /> have been duly noticed and held. The County notes that Section 66474 of the <br /> Government Code is written in the negative. In other words, rather than outline the <br /> findings that must be made to approve a discretionary land use approval, the State <br /> Subdivision Map Act expresses the basis to deny a tentative subdivision map. The <br /> County, using its independent judgment, concludes that none of the findings requiring <br /> denial of the Map can be made. The reasons for this conclusion are provided herein. In <br /> addition, the Development Agreement requires the County to make determinations before <br /> approving discretionary land use applications. These findings also include the <br /> determinations required by the Development Agreement. Furthermore, all applicable <br /> provisions of the Mountain House Development Agreement have been satisfied. <br /> THE PROPOSED MAP IS NOT INCONSISTENT WITH APPLICABLE <br /> GENERAL AND SPECIFIC PLANS. <br /> 2. The County finds that the Map is not inconsistent with the General Plan and the <br /> Mountain House Specific Plan. In addition, the County finds that the Map is consistent <br /> with the Existing Approvals (as that term is used in the Development Agreement), the <br /> Development Agreement and other plans and programs identified in the Development <br /> Agreement. (The General Plan, Specific Plan 1, the Existing Approvals (as that term is <br /> defined in the Development Agreement), other plans and programs identified in the <br /> Development Agreement, and the Development Agreement may be collectively referred <br /> to as the "Consistency Plans.") <br /> 2.A. In reaching this conclusion, the County observes that the law does not <br /> require a precise or exact match between this project and the Consistency Plans. To be <br /> consistent, a project must be compatible with the plan's purpose and policies. This <br /> project does not have to be in perfect conformity with every plan policy. Instead, a <br /> specific project is consistent with the whole of the general plan, specific plan and the <br /> other portions of the Consistency Plans even if it does not precisely match each and every <br /> element. <br /> 1 <br />
