MOUN't-AIN HOUSF,NEIGHBORHOOD"F"PROJECT INITIAL STUDY <br /> Conditions of Approval <br /> HAZ-4: Based on the results of the 1998 study by Condor,the following measures shall be implemented prior to approval of the Final Subdivision Map: <br /> • Remove water well at northeast of site(proposed Lot 985)as per statement on Tentative Map. <br /> • Remove tailwater pond located within the site. <br /> • Ensure that toluene levels detected in soil tests are safe,or remove and properly dispose of the required amount of soil based on the Preliminary Endangerment Assessment <br /> EAprior to construction. <br /> Biological Resources <br /> BI0-1: The applicant shall be required to participated in the SJCMSCP,or alternatively if the SJMSCP is not adopted within three years of the date of the approval of the tentative map, <br /> the fees collected will be used to administer the Mountain House Swainson Hawk HMP,and appropriate mitigation shall be acquired consistent with HMP criteria contained in the Master <br /> Plan. In either case,all applicable Incidental Take Avoidance Measures described in Section 5.2 of the SJMSCP shall be incorporated as conditions of project approval. Issuance of <br /> grading and construction permits shall be contingent on providing evidence of compliance with the SJCMSCP or acceptance of a final Habitat Management Plan in agreanents with the <br /> USFWS and CDFG. <br /> BIO-2: San Joaquin kit fox pre-constriction and construction protocol of the USFWS(1997)shall be followed to ensure that there is no inadvertent take of this endangered species not <br /> Specifi addressed under the SJCMSCP. <br /> BI0-3: Preconstriction surveys shall be conducted for possible nesting activity by raptor species of concern no more than 30 days prior to initiation of ground disturbance on the site. The <br /> pre-construction surveys shall be conducted by a qualified biologist,focusing on potential nesting by burrowing owl,Swainson's hawk,and other raptors. If arty active nests are <br /> Teountered,appropriate construction restrictions shall be developed in consultation with the CDFG to prevent take or abandonment of the active nest until young have fledged. <br /> BI04: For any infrastructure needed to support Neighborhood"F",potential impacts to wetlands shall meet the mitigation requirements of the Corps,CDFG,and Regional Water Quality <br /> Control Board. <br /> Recreation <br /> PARKS-L In compliance with the Master Plan,the neighborhood park construction shall begin as soon as 50 percent of the dwelling unit permits for Neighborhood"F"have <br /> had final inspections,and shall be completed no later than the time 80 percent of dwelling unit permits have had final inspections. The temporary sports fields improvements <br /> shall be constructed prior to the 8000'dwefling unit permit being issued by the County. <br /> Cukural Resources <br /> CULT-1: As stated in the County's Development Title(Chapter 9-1053M),if,during the course of any construction,including any grading activity associated with said <br /> construction,subsurface archaeological features are uncovered anywhere within the project site,work shall be immediately halted in the vicinity of the finding and a qualified <br /> archaeologist consulted for an on-site evaluation. Such evaluation may entail archaeological test excavation and/or mitigative data recovery. The County Coroner,the Native <br /> American Heritage Commission,and an archaeologist shall be informed and consulted if a human prehistoric burial site is discovered during site construction. An agreement <br /> shall be formulated between the Native American representative,the archaeologist,San Joaquin County,and the developer with regard to the proper treatment and disposition of <br /> human remains and associated artifacts. Such treatment and disposition may require archaeological excavation and reburial. <br /> Aesthetics <br /> AESTHETICS-1: Design Guidelines that address parking lot design and landscaping shall be submitted for all development prior to approval of the final maps,parcel maps,or <br /> other development permits. <br /> AESTHETICS-2: Design Guidelines submitted for development within the project area shall incorporate and implement the light and glare recommendations adopted within the <br /> CSD Design Manual. <br /> Energy <br /> ENERGY-1. The Design Guidelines that shall be approved prior to approval of the Final Subdivision Map shall address solar access for individual homes,street plantings, <br /> building design for energy conservation as mentioned in the CECR and pedestrian connections. <br />
