MOUNTAIN HOUSE NEIGHBORHOOD"F"PROJECT INITIAL STUDY <br /> conducted prior to any ground disturbance or tree removal to confirm that no new nests have been established <br /> which could be affected by development. <br /> The following conditions of approval are recommended to mitigate potential less-than-significant impacts on <br /> special-status species: <br /> Condition ofApproval BIO-1: The applicant shall be required to participated in the SJCMSCP,or <br /> alternatively if the SJMSCP is not adopted within three years of the date of the approval of the <br /> tentative map,the fees collected will be used to administer the Mountain House Swainson Hawk <br /> HMP,and appropriate mitigation shall be acquired consistent with HMP criteria contained in the <br /> MasterPlan. In either case,all applicable Incidental Take Avoidance Measures described in <br /> Section 5.2 of the.SJMSCP shall be incorporated as conditions of project approval. Issuance of <br /> grading and construction permits shall be contingent on providing evidence of compliance with the <br /> SJCMSCP or acceptance of a fnal Habitat Management Plan in agreements with the USFWS <br /> and CDFG. <br /> Condition ofAmproval BIO-2: San Joaquin kit fox pre-construction and construction protocol of <br /> the USFWS(1997)shall be followed to ensure that there is no inadvertent take of this endangered <br /> species not specifically addressed under the SJCMSCP. <br /> Condition of Approval BIO-3: Preconstruction surveys shall be conducted for possible nesting <br /> activity by raptor species of concern no more than 30 days prior to initiation ofground disturbance <br /> on the site The pre-construction surveys shall be conducted by a qualified biologist,focusing on <br /> potential nesting by burrowing owl,Swainson's hawk,and other raptors If any active nests are <br /> encountered,appropriate construction restrictions shall be developed in consultation with the <br /> CDFG to prevent take or abandonment of the active nest until young have fledged <br /> b) Have a substantial adverse effect on any riparian habitat or other sensitive natural community identified in <br /> local or regional plans,policies, regulations or by the California Department of Fish and Game or U.S. Fish <br /> and Wildlife Service? <br /> No sensitive natural community types occur within the Neighborhood"F"site,and no adverse impacts on <br /> riparian or other sensitive natural community types are anticipated. The six willow trees in the center of the site <br /> are associated with a drainage ditch,and are not considered part of a natural riparian system. Modifications <br /> proposed along the Mountain House Creek corridor have been sited to avoid freshwater marsh and riparian <br /> habitat,as discussed below under jurisdictional wetlands(see discussion under[c]below). <br /> c) Have a substantial adverse effect on federally protected wetlands as defined by Section 404 of the Clean <br /> Water Act(including, but not limited to, marsh, vernal pool, coastal, etc.) Through direct removal,filling, <br /> hydrological interruption, or other means? <br /> No jurisdictional wetlands would be directly affected as a result of development on the Neighborhood"F"site, <br /> and off-site improvements have been designed to avoid or minimize modifications to wetlands. Secondary <br /> effects of grading and erosion could contribute to sedimentation in Mountain House Creek,unless protective <br /> measures are taken. Similarly,development could contribute to degradation of water quality in the creek as a <br /> result of urban pollutants on the developed site,and measures will be required to minimize non-point pollution <br /> as discussed in the Hydrology and Water Quality section of this Initial Study. A detailed sedimentation and <br /> erosion control plan shall be prepared and implemented as called for in the Hydrology section of this Initial <br /> Study. <br /> Proposed off-site modifications associated with Neighborhood"F"improvements include the following: 1) <br /> C:V0B=C\FNInAL SR)DY\FMALINRIALS=Y-PAR72.D0C(720/00) 110 V.L.
