Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />June 20, 2022 <br /> Facility Address: <br /> 3718 N Tracy Blvd, Tracy <br /> Facility Name: <br /> Denny's # 7935 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 5 HSC 25505(a)(1) Failed to electronically submit hazardous materials inventory for all reportable materials on site. <br />OBSERVATION: The Hazardous Materials Inventory forms for carbon dioxide was not complete. The new federal <br />hazard categories have not been selected. The Physical Gas Under Pressure and the Health Simple Asphyiant are <br />new Federal Hazard Categories that should be selected. <br />REGULATION GUIDANCE :The Hazardous materials inventory information must be current and submitted as part <br />of the business plan. <br />CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is a minor violation. <br /> 8 HSC 25505(a)(4) Failed to establish and electronically submit a reasonable or an adequate training program. <br />OBSERVATION: A training program was not complete. The training did not cover all of the elements stated in the <br />next paragraph. The training program in CERS should be changed to say provided elsewhere in CERS under the <br />emergency response and contingency plan section in CERS. <br />REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, <br />shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or <br />threatened release of a hazardous material. Training shall cover, but not limited to, all of the following: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br /> These training programs may take into consideration the position of each employee. <br />CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California <br />Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, <br />and submit to the EHD for approval. <br />This is a Class II violation. <br />FA0003041 PR0541381 SC001 06/20/2022 <br />EHD 19-01 Rev. 12/06/2021 Hazardous Materials Program OIRPage 2 of 3 <br />1868 E.
