Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />June 21, 2022 <br /> Facility Address: <br /> 1805 HARBOR RD, STOCKTON <br /> Facility Name: <br /> PENNY NEWMAN GRAIN <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. <br />Business plan submittal for 2020 was not submitted. <br />REGULATION GUIDANCE: The business plan shall be submitted by January 15 of each calendar year and may be <br />submitted beginning November 1 of the previous year <br />CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br />annual HMBP to CERS by January 15. <br />This was corrected on site by the facility submitting the business plan on time for 2022. No follow up needed. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were 3 violations violation(s) one <br />corrected on site during the inspection. Complete and submit a copy of the Return to Compliance Certification <br />form to the EHD with a statement documenting the corrective actions that have been or will be taken for each <br />violation, and any supporting paperwork, by July 21, 2022. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br />($152).
