Robert Lopez [EHD] <br /> From: Robert Lopez [EHD] <br /> Sent: Thursday, September 29, 2022 8:51 AM <br /> To: Jeremiah Forest <br /> Subject: RE: PR0539935; Antonini Enterprises LLC Hazardous Materials Program Compliance <br /> Review <br /> Jeremiah Forest, <br /> Perfect, once the map has been submitted I will conduct a review. <br /> Regarding the highlighted chemicals,your business is required to report any hazardous material or a mixture containing <br /> a hazardous material that has a quantity at any one time during the reporting year that is equal to, or greater than, 55 <br /> gallons for materials that are liquids, 500 pounds for solids, or 200 cubic feet for compressed gas. <br /> Excerpt from San Joaquin County Ordinance Code,Title 4, Division 8,4-8005- FAILURE TO FILE. <br /> "A business which has failed to file the required business emergency plan and annual business inventory for <br /> any given year must file the plan and inventory, pay the fees, and pay any late penalty charge for that <br /> particular year and past years for which a plan and inventory was not filed as required by law, upon discovery <br /> of the omission to file. Provided, however, a business will not be required to file a plan and inventory for a <br /> year which is in excess of five (5) calendar years prior to the date of discovery of the omission. All fees and <br /> late penalty charges shall be those set for the year in which the plan and inventory are actually filed." <br /> Be advised,the violation comply by date has passed, consequently all time spent attempting to obtain compliance may <br /> be billed at$156 an hour. <br /> In-office CERS help is available and is provided at EHD hourly rate ($156).
