The missing manifest was: 008119758SKS(12/22/2021). <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br /> with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility <br /> which received the waste. This signed copy shall be retained as a record for at least three years from the date the <br /> waste was accepted by the initial transporter. The hazardous waste generator must submit a copy of the manifest <br /> to the California Department of Toxic Substances Control (DTSC)within 60 days if the destination facility signed <br /> manifest copy is not received from the transporter or designated facility. <br /> CORRECTIVE ACTION: I assisted branch manager Benjamin Kegele with accessing the Department of Toxic <br /> Substances Control's website and obtaining a signed manifest copy of the missing manifest. <br /> This is a Class II violation. <br /> 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: The facility could not provide all of the consolidated manifest receipts for hazardous waste <br /> transported from the site in the past three years. The missing receipts include: <br /> -07/16/2020: 20 gallons of parts washer solution <br /> -06/15/2021: 180 gallons of used oil <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Locate a copy of the receipts listed above. Maintain the records on-site for three years <br /> from the date of shipping and provide a copy to the San Joaquin County Environmental Health Department(EHD). <br /> If the receipts cannot be found, provide a statement to the EHD that future receipts will be maintained on-site for <br /> three years. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by July 28, 2022. <br /> Wastes generated by this facility: oily absorbent, shop towels, metal fines, parts washer solution, aerosol cans, <br /> used oil <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br /> ($152).
