EXHIBIT "A" <br /> 1. The granting of the Deviation will not be materially detrimental to <br /> other properties or land uses in the area. <br /> This Deviation request is for the reduction of a 10' side yard set-back to <br /> 6' (40% reduction) . The neighboring property is a 50' wide BCID Canal. <br /> Since there will be no future development on this described property, the <br /> side yard reduction will not be a detriment to this neighboring property <br /> nor any other surrounding properties. <br /> 2. There are exceptional or extraordinary circumstances or conditions <br /> applicable to the property or to the intended uses that do not apply to <br /> other properties in the same zoning in the vicinity. <br /> The subject property is owned by the Tracy Rural Fire District and <br /> expansion has become a real need due to demand. The proposed apparatus <br /> building is the minimum size required for the fire trucks used and the <br /> front setback of 44 ' ( t ) cannot be reduced further. Due to the size and <br /> triangular shape of the existing property, there is no alternative to <br /> placement of the structure as shown. <br /> 3. The strict application of the regulation deprives the property of <br /> privileges enjoyed by other properties in the vicinity. <br /> As described in #2 above, the lot size and shape have proven to be very <br /> restrictive. The current zoning (GA-40) provides setbacks for parcels of <br /> much larger size and conventional configuration. The existing parcel is <br /> less than 1/2 acre and considering the triangular shape, the actual <br /> available space is much less. Therefore, considering the minimum size of a <br /> parcel in a GA zone is 1 1/2 acres. This parcel does not enjoy the same <br /> "buildable" area enjoyed by other parcels with minimum of 3 times the size. <br /> 4. The granting of the Deviation is consistent with the General Plan. <br /> This Deviation request does not address nor change the current General Plan <br /> ( Ag. ) The use described is allowed within the current General Plan and <br /> zone with a site approval application. <br />
