REVISED <br /> CONDITIONS OF APPROVAL <br /> SA-92-23 & <br /> DV-92-2 <br /> TRACY RURAL FIRE DISTRICT <br /> Unless otherwise specified, the approved use shall not be <br /> established nor building permits issued until the applicant has <br /> fulfilled all Conditions of Approval. <br /> Those Conditions followed by a Section Number or other Statutory <br /> Requirement are based on Ordinance Requirements. Ordinance <br /> Requirements cannot be modified. <br /> 1. DEPARTMENT .OF PUBLIC WORKS: <br /> a. Dedication to result in a 42-foot wide right-of-way from <br /> centerline of Linne Road to the property line shall be <br /> required across the frontage of APN 253-220-03 . <br /> (Planning Title Section 9-2143) <br /> b. The Traffic Impact Mitigation Fee will be required for <br /> this development. The fee is due and payable at the time <br /> of building permit application. (The fee currently is <br /> $1, 126 . 00 per 1, 000 gross square foot of building as <br /> "Warehouse" in the Tracy area. If there is no building <br /> permit required, the fee will be exempt. The fee shall <br /> be automatically adjusted July 1 of each year by the <br /> Engineering Construction Cost Index as published by the <br /> Engineering News Record. (Resolution R-90-304 , R-91- <br /> 1025) <br /> C. Encroachment permit shall be required for work within <br /> read right-of-way. (Streets a•-:d Highway Title Section <br /> 10-3103) <br /> d. The frontage, . improvements for Linne Road shall be <br /> constructed in conformance with the standards for one- <br /> half of an 84-foot right-of-way rural arterial road. The <br /> construction of the frontage improvements will be <br /> deferred, upon execution by the owner of a Deferred <br /> Frontage and Roadway Improvement Agreement or a Secured <br /> Deferred Frontage and Roadway Improvement Agreement with <br /> a deposit equivalent to their estimated construction <br /> costs prior to approval of the Parcel Map. (A $250. 00 <br /> fee currently is required for processing per Planning <br /> Title Section 9-10502 in addition to a copy of the Grant <br /> Deed and an estimate for the required frontage <br /> improvements. The estimate and legal description shall <br /> be prepared by a Registered Civil Engineer with a <br />
