NOA ENVIRONMENTAL JOB NUMBER: LE03-295 <br /> PROPERTY LOCATION: 1801 and 1999 West Linne Road, Tracy, CA <br /> The Phase 1 Environmental Site Assessment <br /> Background <br /> The primary purpose of a Phase 1 Environmental Site Assessment is to provide you, the user of the <br /> report, with some legal protections in the event that previously unknown environmental <br /> contamination is discovered on the site at some time in the future. Under the federal Comprehensive <br /> Environmental Response,Compensation and Liability Act(CERCLA),a current property owner can <br /> be held financially liable for contamination caused by previous owners or occupants of a property, <br /> unless they can meet specific requirements to qualify as an "innocent landowner." Among the <br /> requirements to qualify for this defense is a need to make"all appropriate inquiry into the previous <br /> ownership and uses of the property consistent with good commercial or customary practice." [42 <br /> USC §9601(35)(B)] Frequently, lending institutions require preparation of a Phase 1 report prior to <br /> accepting a property a collateral on a loan to provide the institution with similar protection. <br /> In order to provide a standardized definition of"good commercial or customary practice," the <br /> American Society of Testing and Materials has devised a standard practice, known as ASTM <br /> Standard E1527-00, for conducting Phase 1 Environmental Site Assessments. By retaining NOA <br /> Environmental to complete a Phase 1 according to ASTM E1527-00, you have set in motion an <br /> investigative process by which"all appropriate inquiry into the previous ownership and uses of the <br /> property" will be conducted. Please be aware that while the Phase 1 process is often routine, our <br /> responsibility is not to merely complete a checklist of information sources reviewed, but to <br /> investigate the past ownership or uses of the subject property and nearby properties and identify any <br /> situations which might have caused environmental contamination of the property. <br /> User's Responsibilities <br /> ASTM Standard E1527-00 identifies specific responsibilities on the part of the user to assist in <br /> completing the investigation. It also specifies that the current owner(s) and occupants (if any) be <br /> interviewed. The attached two-part questionnaire is designed to address these specific portions of <br /> the Phase 1 investigation. <br /> Part 1 includes questions which relate specifically to the user's responsibilities, and to additional <br /> information sources which will be useful to us in completing our investigation most efficiently. <br /> Please complete this portion of the questionnaire at your earliest convenience and return it to us <br /> promptly. <br /> Part 2 includes questions to be asked of the current property owner and/or occupants. Please forward <br /> a copy of this portion of the questionnaire to the current owner and request that they complete and <br /> return it as soon as possible.
