CONDITIONS OF APPROVAL PA-0400090 Robertson Minor Subdivision Application No. PA-0400090 was approved by the San Joaquin County Community Development Department on August 9, 2004. The effective date of approval is August 19, 2004. This tentative map approval will expire on August 19, 2007, which is three years from the effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Raymond Hoo, 468-3164) a. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The property descriptions submitted with the Certificate of Compliance application shall substantially conform with the approved tentative map dated February 27, 2004. Access improvement requirements shall be included on the Certificate of Compliance. A fee is required to process the Certificate of Compliance application. (Development Title Section 9-890.4) b. LOT SIZE AND WIDTH:The following lot size and width regulations shall apply to this map: (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. (Development Title Section 9-610.4) (2) All parcels shall have a minimum lot area of 40 gross acres. (Development Title Section 9-310.2) c. ACCESS: The following access requirements apply and shall be included in the Certificate of Compliance property description: (1) The property description for the Certificate of Compliance shall include a minimum 25-foot wide easement for access from Linne Road to each parcel. (2) At the time of development of Parcels 3, 4, and/or 5, the entire length of the private right-of-way for the parcels, including any required secondary access, shall be constructed and maintained to the standards required by Section 10.207 of the Uniform Fire Code and applicable San Joaquin County Improvement Standards. (Development Title Section 9-1150.15[c]) 2. COUNTY COUNSEL a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision, which action is brought within the time provided for in Section 66499.37 of the Government Code.
