NHGLEE BURK IRRIGATION DISTRICT
OFFICERS 1011 Parker Ave. (P.O. Box 1129) TELEPHONES
ALFRED ORNELLAS, PRESIDENT Tracy, California 95378 OFFICE (209)835-3232
LEONARD ALEGRE, VICE PRESIDENT FAX (209)835-4792
WALTER MCINNIS, SECRETARY PUMPHOUSE (209)835-0395
June 28, 1993
San Joaquin County ' ?
Community Development Dept.
1810 East Hazleton Ave. 9 1993
Stockton, CA 95205
Attn: Steve St. Sure--Application No . LA-93-31 'IANNINGDIVISIO
Gentlemen:
This district has the following comments regarding the
proposed lot line adjustment, Application LA-93-31:
1 . The district owns and operates a drainage ditch
along the south edge of the subject property and an
irrigation ditch along the west edge of the property. Both
ditches were installed in about 1911 and ownership is based
on grants to the Naglee Burk Irrigation Association from the
developer of the Naglee Burk Tract . In addition we have
acquired prescriptive rights by virtue of some 80 years of
continuous use.
We believe it would reduce confusion and more fully
advise future purchasers as to their existence if the
easements were shown on the recorded map for all to see.
2 . Under district rules water will be delivered to the
property at the same location where it was delivered in the
past, and at no other place . It will therefore be up to
individual property owners to acquire sufficient easements
to permit the flow of irrigation water to their lands from
the existing district turnout.
Of perhaps more importance, a similar right must be
obtained to drain the northerly lot, which will now be
completely cut off from access to the district ' s drain.
It would be helpful to future purchasers if, as part of
the approval process, the planning staff advised the
applicants of these requirements so that appropriate
arrangements can be made to assure that future owners will
be assured of access to irrigation and drainage.
Very truly yours ,
WALTER J. cINNVI SSe cret
WJM:td
