LA-93-31 �'IANNINGDIVISIO <br /> Gentlemen: <br /> This district has the following comments regarding the <br /> proposed lot line adjustment, Application LA-93-31: <br /> 1 . The district owns and operates a drainage ditch <br /> along the south edge of the subject property and an <br /> irrigation ditch along the west edge of the property. Both <br /> ditches were installed in about 1911 and ownership is based <br /> on grants to the Naglee Burk Irrigation Association from the <br /> developer of the Naglee Burk Tract . In addition we have <br /> acquired prescriptive rights by virtue of some 80 years of <br /> continuous use. <br /> We believe it would reduce confusion and more fully <br /> advise future purchasers as to their existence if the <br /> easements were shown on the recorded map for all to see. <br /> 2 . Under district rules water will be delivered to the <br /> property at the same location where it was delivered in the <br /> past, and at no other place . It will therefore be up to <br /> individual property owners to acquire sufficient easements <br /> to permit the flow of irrigation water to their lands from <br /> the existing district turnout. <br /> Of perhaps more importance, a similar right must be <br /> obtained to drain the northerly lot, which will now be <br /> completely cut off from access to the district ' s drain. <br /> It would be helpful to future purchasers if, as part of <br /> the approval process, the planning staff advised the <br /> applicants of these requirements so that appropriate <br /> arrangements can be made to assure that future owners will <br /> be assured of access to irrigation and drainage. <br /> Very truly yours , <br /> WALTER J. cINNVI S��Se cret <br /> WJM:td <br />
