OBSERVATION: This business does not have a hazardous waste ID number in the California Department of Toxic Substances Control (DTSC)database. REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of,transport or offer for transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification (ID) Number.A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID numbers are unique to a business and site location. CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ to obtain an ID number. Immediately apply for your ID number and submit evidence to the San Joaquin County Environmental Health Department within 30 days. This is a Class II violation. 303 CCR 66262.34(d)(2) Failed to maintain all communication or alarm systems, spill control, or decontamination equipment. OBSERVATION: The fire extinguisher located in the office had their gauge pointing outside the green section. REGULATION GUIDANCE:All facility communications or alarm systems,fire protection equipment, spill control equipment, and decontamination equipment,where required, shall be tested and maintained as necessary to assure its proper operation in time of emergency. CORRECTIVE ACTION: Bring the fire extinguisher into proper working order by repair, replacement or testing. Provide a corrective action statement to the San Joaquin County Environmental Health Department within 30 days. This is a Class II violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by July 23, 2022. Wastes generated by this facility: oily solids (rags, absorbent, filters), used oil Note: There was no hazardous waste on site at the time of the inspection. Per Abel, he has mostly been replacing mufflers but anticipates that he will be generating used oil and filters. Per Abel, the business relocated to this address at the end of January 2022. Abel stated that he has not applied for a new EPA ID number because he thought he could continue using the old one. I completed the state EPA ID application with Abel at the time of the inspection. To minimize person to person contact EHD is choosing to write the name of person receiving the report instead of having them sign.
