S A N J 0 A Q I I I Irl Environmental Health Department <br /> CCUN r <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> Gemco Ripon Truck Plaza Inc. 1002 E FRONTAGE RD, RIPON March 10, 2022 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 101 CCR 66262.12 Managed a hazardous waste without an identification number. <br /> OBSERVATION: This business does not have an active hazardous waste ID number in the California Department <br /> of Toxic Substances Control (DTSC)database. <br /> REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of,transport or offer for <br /> transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification <br /> (ID) Number.A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br /> month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID <br /> numbers are unique to a business and site location. <br /> CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ <br /> to obtain an ID number. Immediately apply for your ID number and submit evidence to the San Joaquin County <br /> Environmental Health Department within 30 days. <br /> This is a repeat violation, Class II. <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: Two blue 55 gallon plastic drums observed on the east side of the building with no labeling and <br /> has unknown liquid. Per Khoja Siddiqi, supervisor, the drums did not belong to them but was left by the previous <br /> tenant. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> Title 22 CCR section 66261.2—Definition of Waste <br /> Title 22 CCR section 66261.3—Definition of Hazardous Waste <br /> A business operator shall keep records of any hazardous waste determinations made in accordance with Title 22 <br /> California Code of Regulations(CCR)section 66262.11 for at least three years from the date that the waste was last <br /> sent to an on-site or off-site treatment, storage,or disposal facility. The records may include Safety Data Sheets <br /> (SDS), waste test results or other hazardous waste determination documentation. <br /> CORRECTIVE ACTION: Immediately remove the drums, make a hazardous waste determination for each waste , <br /> and manage it according to Title 22 CCR. Use Safety Data Sheets (SDS),waste sampling and test results or other <br /> knowledge to support your hazardous waste determination. Waste testing must be done using methods specified in <br /> Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
